Gentlemen:

Niagara Mohawk Power Corporation (NMPC) transmitted an Application for Amendment regarding the above subject by letter dated October 16,-1998 (NMP2L 1830). Subsequently, by letters dated March 26, 1999; May 10, 1999; May 18, 1999; June 16, 1999 and September 2, 1999, the Nuclear Regulatory Commission (NRC) requested additional information pertaining to the Application for Amendment. NMPC provided the requested additional information by letters dated May 10, 1999 (NMP2L 1866); June 15, 1999 (NMP2L 1872);

July 30, 1999 (NMP2L 1881); August 2, 1999 (NMP2L 1883); August 11, 1999 (NMP2L 1885); August 16, 1999 (NMP2L 1886); August 19, 1999 (NMP2L 1888); August 27, 1999 (NMP2L 1893) and September 10, 1999 (NMP2L 1896). The additional information provided by NMPC in these letters included commitments to revise the Application for Amendment.

Accordingly, the Enclosure to this letter provides the appropriate changes to our Application for Amendment regarding Volumes 1 through 11 of our October 16, 1998 submittal. The specific changes are annotated by a vertical bar and a "B" in the right margin.

Attachment 1 of this letter provides a summary of the changes to the proposed License Amendment. In addition, Attachment 2 provides the discard and insertion instructions pertaining to the integration of the proposed changes into our Application for Amendment dated October 16, 1998.

NMPC has determined that the revision of our proposed License Amendment does not involve a significant hazards consideration. The evaluation supporting this determination is included in the enclosure to our letter dated October 16, 1998, as revised by the enclosure to this letter.

Page 2 occupational radiation exposure. Accordingly, the revision of our proposed License Amendment meets the eligibility criteria for categorical exclusion as set forth in 10 CFR 51.22(c)(9). Therefore, pursuant to 10 CFR 51.22(b), an environmental assessment of the revision to our proposed License Amendment is not required.

Pursuant to 10 CFR 50.91(b)(1), NMPC has provided a copy of the revision to this License Amendment application and the associated analysis regarding no significant hazards consideration to the appropriate state representative.

SUMMARY

OF CHANGES This attachment provides a brief summary of the changes in Revision B. The original Technical Specification amendment request (Revision A) was submitted to the NRC on October 16, 1998.

The summary of the changes is provided in Chapter/Section order. Within each Chapter/Section, changes resulting from an NRC Request for Additional Information (RAI) are provided first, followed by additional changes identified by Nine Mile Point Unit 2 (NMP2), Page removal and insert instructions have also been provided in Attachment 2 to facilitate updating the amendment request to include Revision B.

1. The changes committed to in the NMP2 response to RAI 1 have been made. The changes affect Improved Technical Specification (ITS) 1.1, page 1.1-3, the Current Technical Specification (CTS) markup for Chapter 1.0, page 5 of 15, and the Improved Standard Technical Specification (ISTS) markup, page 1.1-3.

The word "significant" had been removed from the Background and Applicable Safety Analyses sections of the ITS 2.1.1 Bases when referring to the fuel cladding integrity safety limit (no significant fuel damage is calculated to occur). After a phone conversation with the NRC and further review, this word will be maintained. This change affects ITS 2.1.1, Bases pages B 2.0-1 and B 2,0-3, the ISTS Bases markup pages B 2.0-1 and B 2.0-4, and the Justification for Deviations (JFD) to Bases Chapter 2.0, JFD 1 (page 1).

2. A typographical error was noted in the Reference section of the ISTS 2.1.2 Bases, in that a reference identified in the Reference section was not used in the body of the Bases. Thisreference(GDC28) hasbeen deleted. This changeaffectsITS2.1.2, Bases page B 2.0-8 and the ISTS Bases markup page B 2.0-11.

Therefore, the currently approved CTS page is provided. This change affects the CTS markup for Section 3.0, page 5 of 8.

It was noted that a statement concerning under what conditions the minimum Source Range Monitor count rate was determined, i.e., "with the detector full in," was added into the Bases for Surveillance Requirement (SR) 3.3.1.2.4. This statement is not in the ISTS 3.3.1.2 Bases (since it is already effectively covered by the first paragraph of the Background section of the Bases) and has been deleted. This change affects ITS 3.3.1.2 Bases page B 3.3-39 and the ISTS Bases markup page B 3.3-40.

It was noted that, in the CTS markup and Discussion of Changes for ITS 3.3.2.2, an "LA" DOC was used to describe the change to the "simulated automatic operation" 4 of 18

portion of CTS 4.3.9.2. In other Technical Specifications where the actuated components do not have an individual system Technical Specification (i.e., EOC-RPT and ATWS-RPT), the change to the same portion of the comparable requirement was described using an "A" DOC. Therefore, for consistency with how this change was described in other similar requirements, an "A" DOC has been provided and the "LA" DOC" has been deleted. This change affects the CTS markup for ITS 3.3.2.2, page 1 of 5, and the Discussion of Changes for ITS 3.3.2.2, DOC A.5 (page 1) and DOC LA.1 (page 2).

20. A typographical error was noted in the Discussion of Changes for ITS 3.3.3.2, DOC LE.1 (the value "30" was inadvertently repeated). This has been corrected. This change affects the Discussion of Changes for ITS 3.3.3.2, DOC LE.1 (page 4).
21. A typographical error was noted in the Discussion of Changes for ITS 3.3.4.1, DOC LA.1 (SR 3.3.4.1.5 should have been SR 3.3.4.1.4) This has been corrected. This

change affects the Discussion of Changes for ITS 3.3.4.1, DOC LA.1 (page 3).

22. Typographical errors were noted in the Justification for Deviations to ITS 3.3.5.1, JFD 3 (the Function numbers were incorrectly identified). The correct Function numbers were provided to the NRC reviewer during a phone conversation. These errors have been corrected. This change affects the Justification for Deviations to ITS 3.3.5.1, JFD 3 (page 1).

A typographical error was noted in the Discussion of Changes for ITS 3.3.6.1, DOC M.5 (Function 2.d should have been Function 2.c). This has been corrected. This change affects the Discussion of Changes for ITS 3.3.6.1, DOC M.5 (page 8).

24. It was noted that the use of the term "room" and "area" and the term "pump" in the ITS 3.3.6.1 Bases was not consistent with the use in ITS Table 3.3.6.1-1. This has been corrected. These changes affect ITS 3.3.6.1 Bases pages B 3.3-169 and B 3.3-176 and the ISTS Bases markup pages B 3.3-156 and insert page B 3.3-164.
25. NMP2 License Amendment 85, issued by the NRC on December 22, 1998, removed CTS 3/4.3.7.3, the Meteorological Monitoring Instrumentation from the Technical Specifications. Therefore, changes have been made as a result of this amendment.

These changes affect the Split Report (Attachment page 6 and Appendix 1 page 9 of 43), the CTS markup for Current Specification 3/4.3.7.3, page 1 of 3, page 2 of 3, and page 3 of 3 (all pages deleted), the Discussion of Changes for CTS 3/4.3.7.3 (deleted),

the Discussion of Changes for ITS Section 3.3 - Instrumentation Bases (page 1), and the No Significant Hazards Evaluation for CTS 3/4.3.7.3 (deleted). In addition, typographical errors on the Discussion of Changes for ITS Section 3.3-Instrumentation Bases (page 1) were also corrected.

Grammatical errors were noted in the ISTS 3.3.8.2 and 3.3.8.3 Bases markup. The first and second sentences of the Bases for SR 3.3.8.2.3 and SR 3.3.8.3.3 have been combined into one sentence, consistent with the wording in the BWR/4 ISTS, NUREG-1433, Rev. 1. These changes affect ITS 3.3.8.2 Bases page B 3.3-233, ITS 3.3.8.3 Bases page B 3.3-241, and ISTS Bases markup pages B 3.3-246 and insert page B 3.3-246i.

The changes committed to in the NMP2 response to RAI 3.5. 1-1 have been made.

47. NMP2 noted that the method described in the ITS 3.6.2.1 Bases by which suppression pool average temperature is determined is not the normal method used by NMP2 operations personnel. The normal method uses the Technical Specification required post accident monitoring instrumentation. Therefore, the normal method has been added to the ITS SR 3.6.2.1.1 Bases. This change affects ITS 3.6.2.1 Bases page B 3.6-52 and the ISTS Bases markup page B 3.6-60.
48. NMP2 committed (in the response to RAI 3.6.1.3-21) to make changes to the Limiting Condition for Operation (LCO) section of the ITS 3.6.1.3 Bases. In reviewing these changes, it was noted that similar words appear in the LCO section of the ITS 3.6.4.2 Bases.
