Dear Mr. Giessner:

On December 15, 2017 Mr. Robert Gattone, Jr., from your Agency performed a Safety Inspection Report and Compliance Inspection at Cargill Incorporated's (Cargill) Hammond, Indiana facility. The inspection noted a violation of 10 CFR 30.36(d) for two instruments:

  • Texas Nuclear fixed gauge Model 5191 containing cesium-137 sealed source located in Building 53 and not used since June 11, 2014
  • Texas Nuclear fixed gauge Model 5201 containing cesium-137 sealed source located in Building 87 and not used since August 2014 This letter is to provide the corrective actions for the noted violation. Cargill has developed two corrective actions. The first corrective action is to revise our annual internal audit/inspection process, and the second corrective action is to remove and dispose of out of service sources. Cargill's annual radiation device internal audit/inspection was revised to note out-of-service sources, include the date the source was removed from service, and to verify that the 10 CFR 30.36 notification requirements are met. Cargill has contacted the Chase Environmental Group, Inc. (Chase) from Louisville, Kentucky and received a proposal from them to remove and dispose of the Texas Nuclear gauges Model numbers 5191 and 5201. Chase will provide a Radiation Safety specialist to remove and properly package the sources for transport to the disposal facility. Chase will also arrange for transportation to Waste Control Specialists (WCS) in Andrews, Texas. Cargill will provide the NRC with notifications and maintain the associated records as required by our license.
