ACCEPTANCE OF REQUESTED LICENSING ACTION RE: AMENDMENT REQUEST FOR EMERGENCY OPERATIONS FACILITY CONSOLIDATION (CAC NOS. MF7650, MF7651, MF7652, MF7653, MF7654, MF7655, MF7656, MF7657, MF7658, MF7659, AND MF7660)

Dear Mr. Glover:

By letter dated April 29, 2016 (Agencywide Documents Access and Management System Accession No. ML16120A076), Duke Energy (the licensee) submitted a license amendment request (LAR) for the Brunswick Steam Electric Plant, Unit Nos. 1 and 2 (Brunswick); Catawba Nuclear Station, Units 1 and 2; Shearon Harris Nuclear Power Plant, Unit 1 (Harris); McGuire Nuclear Station, Units 1 and 2; Oconee Nuclear Station, Units 1, 2, and 3; and H. B. Robinson Steam Electric Plant, Unit No. 2 (Robinson). The proposed amendment would (1) consolidate the Emergency Operations Facilities (EOFs) for Brunswick, Harris, and Robinson with the Duke Energy corporate EOF (hereafter referred to as the Charlotte EOF) in Charlotte, North Carolina; (2) change the Brunswick, Harris, and Robinson augmentation times to be consistent with those of the sites currently supported by the Charlotte EOF, and (3) decrease the frequency of the unannounced augmentation drills at Brunswick from twice per year to once per year.

The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff's acceptance review of this amendment request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (1 O CFR), an amendment to the license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required.

This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staff's

The NRC staff notes that Duke Energy is concurrently requesting to use the Charlotte EOF as the EOF for the William States Lee Ill Nuclear Station (Lee) in the Lee combined license (COL) application. The Lee COL application is currently under review by the NRC staff. In its letter dated April 29, 2016, the licensee acknowledged that another submittal may be needed if the COL for the Lee Station is approved.
