Letter from NRC to TVA, Browns Ferry Nuclear Plant - NRC Integrated Inspection Report 05000259/2013005, 05000260/2013005, and 05000296/2013005, Preliminary White Finding and Apparent Violations, dated February 14, 2014 This letter provides the Tennessee Valley Authority (TVA) response to Apparent Violation 05000259, 260, 296/2013005-02, Failure to Maintain Emergency Response Staffing Levels, documented in the referenced inspection report. This inspection report contained two additional Apparent Violations, 05000259, 260, 296/2013005-03 (Inaccurate Information Provided Concerning Onsite Emergency Response Organization Staffing Requirements) and 05000259, 260, 296/2013005-04 (Inappropriate Amendment of License Conditions),

which will not be addressed in this correspondence. On February 24, 2014, TVA requested Alternative Dispute Resolution with the Nuclear Regulatory Commission to discuss the latter two apparent violations.

The referenced inspection report discusses Apparent Violation 05000259, 260, 296/2013005-02, which the Nuclear Regulatory Commission has preliminarily determined to be a finding with low to moderate safety significance (White). The finding resulted from the failure to maintain plant emergency response staffing levels in accordance with the Tennessee Valley Authority Nuclear Power Radiological Emergency Plan. Specifically, Browns Ferry Nuclear Plants (BFN) process for maintaining minimum emergency response shift staffing failed to adequately maintain staffing of the Shift Technical Advisor and Incident Commander to ensure initial accident response in all key functional areas. The TVA acknowledges that the condition existed as documented in the inspection report.
