Dear Mr. Gellrich:

The Commission has issued the enclosed Amendment No. 296 to Renewed Facility Operating License No. DPR-53 and Amendment No. 272 to Renewed Facility Operating License No.

DPR-69 for the Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2. The amendments consist of changes to Technical Specification (TS) Section 5.0, "Administrative Controls," in response to your application dated April 5, 2010. Specifically, the changes include:

(1) Replacement of the use of plant-specific titles to generic titles consistent with TS Task Force (TSTF) Traveler TSTF-65, Revision 1, "Use of Generic Titles for Utility Positions,"

(2) Changes made to more closely align selected TSs with the Improved Standard TSs, and (3) Administrative changes to specified TSs.

A copy of the related Safety Evaluation is enclosed. A Notice of Issuance will be included in the Commission's next regular biweekly Federal Register notice.

(a) For Surveillance Requirements (SRs) that are new, in Amendment 227 to Facility Operating License No. DPR-53, the first performance is due at the end of the first surveillance interval that begins at implementation of Amendment 227. For SRs that existed prior to Amendment 227, including SRs with modified acceptance criteria and SRs whose frequency of performance is being extended, the first performance is due at the end of the first surveillance interval that begins on the date the Surveillance was last performed prior to implementation of Amendment 227.

(3) Additional Conditions The Additional Conditions contained in Appendix C as revised through Amendment No. 295 are hereby incorporated into this license. Calvert Cliffs Nuclear Power Plant, LLC shall operate the facility in accordance with the Additional Conditions.

(4) Secondary Water Chemistry Monitoring Program The Calvert Cliffs Nuclear Power Plant, LLC, shall implement a secondary water chemistry monitoring program to inhibit steam generator tube degradation. This program shall include:

a. Identification of a sampling schedule for the critical parameters and control points for these parameters;

b. Identification of the procedures used to quantify parameters that are critical to control points; Amendment No. 296

This license is deemed to contain and is subject to the conditions set forth in 10 CFR Chapter I and is subject to all applicable provisions of the Act, and the rules, regulations, and orders of the Commission, now and hereafter applicable; and is subject to the additional conditions specified and incorporated below:

(3) Less Than Four Pump Operation The licensee shall not operate the reactor at power levels in excess of five (5) percent of rated thermal power with less than four (4) reactor coolant pumps in operation. This condition shall remain in effect until the licensee has submitted safety analyses for less than four pump operation, and approval for such operation has been granted by the Commission by amendment of this license.

(4) Environmental Monitoring Program If harmful effects or evidence of irreversible damage are detected by the biological monitoring program, hydrological monitoring program, and the radiological monitoring program specified in the Appendix B Technical Specifications, the licensee will provide to the staff a detailed analysis of the problem and a program of remedial action to be taken to eliminate or significantly reduce the detrimental effects or damage.

Organization 5.2 5.0 ADMINISTRATIVE CONTROLS 5.2 Organization 5.2.1 Onsite and Offsite Organizations Onsite and offsite organizations shall be established for unit operation and corporate management, respectively. The onsite and offsite organizations shall include the positions for activities affecting safety of the nuclear power plant.

a. Lines of authority, responsibility, and communication shall be defined and established throughout highest management levels, intermediate levels, and all operating organization positions. These relationships shall be documented and updated, as appropriate, in organization charts, functional descriptions of departmental responsibilities and relationships, and job descriptions for key personnel positions, or in equivalent forms of documentation. These requirements including the plant-specific titles of those personnel fulfilling the responsibilities of the positions delineated in these Technical Specifications, shall be documented in the Updated Final Safety Analysis Report (UFSAR) or Quality Assurance Topical Report;

b. The plant manager shall be responsible for overall safe operation of the plant and shall have control over those onsite activities necessary for safe operation and maintenance of the plant;

c. A specified corporate officer shall have corporate responsibility for overall plant nuclear safety and shall take any measures needed to ensure acceptable performance of the staff in operating, maintaining, and providing technical support to the plant to ensure nuclear safety; and

d. The individuals who train the operating staff, carry out health physics, or perform quality assurance functions may report to the appropriate onsite manager; however, these individuals shall have sufficient organizational freedom to ensure their independence from operating pressures.

Organization 5.2 5.2 Organization 5.2.2 Unit Staff The unit staff organization shall include the following:

a. A total of three non-licensed operators shall be assigned to the Units 1 and 2 shift crews.

b. Those licensed operators counted toward mlnlmum shift crew composition required by 10 CFR 50.54(m)(2)(i) shall be licensed for both units.

c. Shift crew composition may be less than the minimum requirement of 10 CFR 50.54(m)(2)(i), 5.2.2.a, and 5.2.2.g for a period of time not to exceed 2 hours2.314815e-5 days <br />5.555556e-4 hours <br />3.306878e-6 weeks <br />7.61e-7 months <br /> in order to accommodate unexpected absence of on-duty shift crew members provided immediate action is taken to restore the shift crew composition to within the minimum requirements.

d. A radiation protection technician shall be onsite when fuel is in the reactor. The position may be vacant for not more than 2 hours2.314815e-5 days <br />5.555556e-4 hours <br />3.306878e-6 weeks <br />7.61e-7 months <br />, in order to provide for unexpected absence, provided immediate action is taken to fill the required position.

e. Deleted.

f. The operations manager or assistant operations manager shall hold an SRO license.

g. One Shift Technical Advisor (STA) shall be assigned to the shift crew when either unit is in MODE I, 2, 3, or 4, and shall be filled as follows:

1. By the Shift Supervisor (SS) or an on-shift SRO license holder, provided the individual meets the Commission Policy Statement on Engineering Expertise on Shift; or CALVERT CLIFFS - UNIT 1 5.2-2 Amendment No. 296 CALVERT CLIFFS - UNIT 2 Amendment No. 272

Programs and Manuals 5.5 5.5 Programs and Manuals be taken whenever the program limits are exceeded. The program shall include the following elements:

a. Limitations on the functional capability of radioactive liquid and gaseous monitoring instrumentation, including surveillance tests and setpoint determination, in accordance with the methodology in the ODCM;

b. Limitations on the concentrations of radioactive material released in liquid effluents to unrestricted areas, conforming to 10 CFR Part 20, Appendix B, Table II, Column 2;

c. Monitoring, sampling, and analysis of radioactive liquid and gaseous effluents in accordance with 10 CFR 20.1302 and with the methodology and parameters in the ODCM;

d. Limitations on the annual and quarterly doses or dose commitment to a member of the public from radioactive materials in liquid effluents released from the site to unrestricted areas to be limited:

1. During any calendar quarter: Less than or equal to 3 mrems to the total body, and to less than or equal to 10 mrems to any organ; and

2. During any calendar year: Less than or equal to 6 mrems to the total body, and to less than or equal to 20 mrems to any organ;

e. Determination of cumulative dose contributions from radioactive effluents for the current calendar quarter and current calendar year, in accordance with the methodology and parameters in the ODCM, at least every 31 days.

Determination of projected dose contributions from radioactive effluents in accordance with the methodology in the ODCM at least every 31 days;

f. Limitations on the functional capability and use of the Liquid Radwaste Treatment System to ensure that appropriate portions of this system are used to reduce releases of CALVERT CLIFFS - UNIT 1 5.5-3 Amendment No. 296 CALVERT CLIFFS - UNIT 2 Amendment No. 272

2. During any calendar year: Less than or equal to 20 mrads for gamma radiation, and less than or equal to 40 mrads for beta radiation;

k. Limitations on the annual and quarterly doses to a member of the public from Iodine-131, Iodine-133, Tritium, and all radionuclides in particulate form with half-lives greater than 8 days, in gaseous effluents released from the site to areas beyond the site boundary, to be limited:

1. During any calendar quarter: Less than or equal to 15 mrems to any organ:

2. During any calendar year: Less than or equal to 30 mrems to any organ; and

3. Less than 0.1% of the limits of 5.5.4.k(l) and (2) as a result of burning-contaminated oil; and

1. Limitations on the annual dose or dose commitment to any member of the public, beyond the site boundary, due ~~

releases of radioactivity, and to radiation from uralll\,AII' '\,Al:,

cycle sources to be limited to less than or equal to 25 mrems to the total body or any organ, except the thyroid, which shall be limited to less than or equal to 75 mrems.

The provisions of SR 3.0.2 and SR 3.0.3 are applicable to the Radioactive Effluent Controls Program surveillance frequency.

5.5.5 Component CYclic or Transient Limit This program provides controls to track the UFSAR, Section 4.1 cyclic and transient occurrences to ensure that components are maintained within the design limits.

DPR-53 AND AMENDMENT NO. 272 TO RENEWED FACILITY OPERATING LICENSE NO. DPR-69 CALVERT CLIFFS NUCLEAR POWER PLANT, LLC CALVERT CLIFFS NUCLEAR POWER PLANT, UNIT NOS. 1 AND 2 DOCKET NOS. 50-317 AND 50-318

1.0 INTRODUCTION

By application dated April 5, 2010 (Agencywide Documents and Access Management System Accession No. ML100970070), Calvert Cliffs Nuclear Power Plant, LLC, (Calvert Cliffs, or the licensee), requested changes to Technical Specification (TS) Section 5.0, "Administrative Controls," for the Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2. The proposed changes would replace plant-specific titles with generic titles, implement changes to the license requirements for the operations manager or assistant operations manager, align the listed gaseous effluents in TS 5.5.4.k with the gaseous effluents identified in the improved standard TSs (ISTS), and replace the words "each unit" with the words "the site" in describing limitations of released gaseous and liquid effluents.

2.0 REGULATORY EVALUATION

Title 10 of the Code of Federal Regulations (10 CFR) 50.36 requires that each licensee operate in accordance with plant-specific TSs. The requirement in 10 CFR 50.36(c)(5) specifies that the TS will include a section on Administrative Controls. The Administrative Controls provide provisions relating to organization and management, procedures, recordkeeping, review and audit, and reporting necessary to assure operation of the facility in a safe manner. At Calvert Cliffs, the Administrative Controls are located in TS Section 5.0.

Several of the requested changes would bring the Calvert Cliffs TSs into closer alignment with the ISTS. These are the changes to TSs 5.2.2.f and 5.5.4.k. On July 22, 1993, the Commission issued its Final Policy Statement which described the safety benefits of the ISTS and encouraged licensees to use the ISTS as the basis for plant-specific TS amendments and for completing TS conversions based on the ISTS.

The change from a plant-specific title to a generic title in TS 5.2.1.c is in accordance with TS Task Force (TSTF) Traveler 65 which was also adopted into the ISTS as described in NUREG-1432 Vol. 1, Revision 3.0, "Standard Technical Specifications Combustion Engineering Plants."

-2 10 CFR 50.54(1) requires, in part, "... the licensee to designate individuals to be responsible for directing the licensed activities of licensed operators. These individuals shall be licensed as senior operators pursuant to part 55 of this chapter." At Calvert Cliffs, this is currently met by requiring the Operations Manager to hold, or have held, a Senior Reactor Operator (SRO)

License at Calvert Cliffs and for the General Supervisor Nuclear Plant Operations to hold an SRO license. The proposed change conforms to the format and content of NUREG-1432 and meets the requirements contained in American National Standards Institute N18.1-1971 which Calvert Cliffs has committed to.

The proposed changes to TS Sections 5.2.1.a, 5.5.4.d, and 5.5.4.k are administrative in nature and, as such do not have associated regulatory requirements or guidance.

3.0 TECHNICAL EVALUATION

3.1 Revise TS 5.2.1.c to replace the title "Vice President-Nuclear Energy" with the generic title "A specified corporate officer" This change would replace a plant-specific title with a generic title in accordance with TSTF-65, NUREG-1432. In its application, the licensee stated that it will make a conforming change to the appropriate sections of the Calvert Cliffs Updated Final Safety Analysis Report to document the alignment of the site specific personnel titles to the generic personnel titles. The responsibilities and requirements of the position remain unchanged, and is, therefore, administrative in nature, and the NRC staff finds this change acceptable.

3.2 Revise TS 5.5.4.k to add "lodine-133. Tritium," following the words "lodine-131" This change would correct an omission from the licensee's conversion from custom TSs to the revised standard TSs. This correction more closely matches the format and content of NUREG 1432. In its application, the licensee stated that these two additional gaseous effluents have been, and will continue to be monitored using a plant procedure. This more restrictive change would make the existing monitoring part of their TSs. The NRC staff finds this change acceptable.

3.3 Revise TS 5.5.4.d and 5.5.4.k to replace the words "each unit" with "the site" This change would replace the words "each unit" with "the site" in TS 5.5.4.d and 5.5.4.k. The current TSs describe dose limits from each unit. These per unit dose limits equal the dose limits for the entire two unit site as described in 10 CFR Part 50, Appendix I. The implication in the TSs is that the site limit is double what is actually allowed by the regulation. This inconsistency is corrected by the proposed change and reflects the actual situation that the two units are adjacent and the monitoring is done at the shared site boundary for both units. The proposed change does not change the regulated liquid effluent limits for the site as monitored at the site boundary, or any existing plant process or procedure, and is, therefore, administrative in nature, and the NRC staff finds this change acceptable.

-3 3.4 Revise Technical Specification 5.2.1.a by changing the title "Quality Assurance Policy" to its correct corporate title of "Quality Assurance Topical Report" This change to TS 5.2.1.a would update the TS to the correct corporate title of "Quality Assurance Topical Report (QATR)." The NRC staff finds it acceptable.

3.5 Revise TS 5.2.2.f This change would revise TS 5.2.2.f to state "The operations manager or assistant operations manager shall hold an SRO license." Currently, the Operations Manager must hold (or have held) an SRO license from Calvert Cliffs, and the General Supervisor - Nuclear Plant Operations must hold an SRO license. This change allows either the Operations Manager or Assistant Operations Manager to hold an SRO license, however, that license must be current. Having either the Operations Manager or Assistant Operations Manager holding an SRO license would meet the requirements of 10 CFR 50.54(1). There will no longer be any requirement for the General Supervisor - Nuclear Plant Operations to be licensed. This proposed change conforms to the format and content of NUREG-1432 and is consistent with American National Standards Institute N18.1-1971. It also provides acceptable assurance of operational knowledge and experience within operations management to provide day-to-day interface with the operational aspects of control room activities and to communicate operational issues to higher level management. The proposed change ensures that the senior operator knowledge is maintained at the manager level and, therefore, the NRC staff finds this change acceptable.

4.0 STATE CONSULTATION

In accordance with the Commission's regulations, the Maryland State official was notified of the proposed issuance of the amendments. The State official had no comments.

5.0 ENVIRONMENTAL CONSIDERATION

The amendment relates to changes in recordkeeping, reporting, or administrative procedures or requirements. Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(1 0). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.

6.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above that (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.

CALVERT CLIFFS NUCLEAR POWER PLANT, UNIT NOS. 1 AND 2 AMENDMENT RE: PERSONNEL TITLE REVISIONS AND ADMINISTRATIVE CHANGES IN TECHNICAL SPECIFICATION SECTION 5.0, ADMINISTRATIVE CONTROLS (TAC NOS. ME3696 AND ME3697)

Dear Mr. Gellrich:

The Commission has issued the enclosed Amendment No. 296 to Renewed Facility Operating License No. DPR-53 and Amendment No. 272 to Renewed Facility Operating License No.

DPR-69 for the Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2. The amendments consist of changes to Technical Specification (TS) Section 5.0, "Administrative Controls," in response to your application dated April 5, 2010. Specifically, the changes include:

(1) Replacement of the use of plant-specific titles to generic titles consistent with TS Task Force (TSTF) Traveler TSTF-65, Revision 1, "Use of Generic Titles for Utility Positions,"

(2) Changes made to more closely align selected TSs with the Improved Standard TSs, and (3) Administrative changes to specified TSs.

A copy of the related Safety Evaluation is enclosed. A Notice of Issuance will be included in the Commission's next regular biweekly Federal Register notice.
