APPENDIX A NOTICE OF VIOLATION Northeast Nuclear Energy Company Docket No. 50-423 Millstone Unit 3 License No. CPPR-113 Based on the results of an NRC inspection conducted during the period of May 20 through June 14, 1985, and in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), published in the Federal Register Notice (49 FR 8583) dated March 8, 1984, the following violations were identified: CFR 50, Appendix B Criterion IX requires nondestructive examination to be controlled and accor..plished in accordance with applicable codes, standards, specifications, criteria and other special requirement Site fabrication and engineering procedures 2280.000-968 and 2280.000-149 and radiographic procedures QAD-9.41ML, Revision A, change 1 and RT-405, Revision II, invoke Section III of the ASME Boiler and Pressure Vessel Code, 1971 edition with addenda through 1973, for the acceptance / rejection criteria associated with Class 2 component Article NB/NC 5320 of Section III of the Code requires that welds with indications of zones of incomplete fusion or with elongated indications greater than 1/4 inch for material thicknesses up to 3/4 inch be rejected and Article N85310 provides the disposition for welds so reiecte Contrary to the above, an NRC review of site radiographs disclosed that field weld RSS-9-FW2 in an ASME Class 2 pipe contained a zone of incomplete fusion which was not previously identified and dispositioned by site personnel and that ASME Class 2 shop weld RSS-7-3-4-2-SWB contained an elongated indication exceeding Code acceptable limits which had not been identified and dispositioned by the vendo This is a Severity Level IV Violatio (Supplement II) CFR 50, Appendix B Criterion V requires that activities affecting I quality shall be accomplished using appropriate procedure Site Quality Assurance and Quality Control manual, ASME Section III Div. 1 Section 9 Rev. L. (Fabrication and Installation Control) paragraph 2.2.4A. requires that items fabricated by other than site organizations shall be identified on the controlled drawings by their unique identifica-tion number Contrary to the above all items shown on control drawing 2179 MSS-32 Rev. 2, dated August 30, 1984, were not uniquely identified in that OFFICIAL RECORD COPY IR MILLSTONE 3 85-22 - 0002. /27/85 0500200291 850813 gDR ADOCK 05000423 PDR

Appendix A 2 the procedure depicted two shop welds on a pipe spool which were identified as Tubeco welds SWIC and SWID when, in fact, these welds had been removed and replaced by Southwest Fabrication shop welds SW-2 and SW- This is a Severity Level V Violatio (Supplement II)

Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
