050-00156/97001(DNMS) AND NOTICE OF VIOLATION

Dear Mr. Torphy:

This refers to the safety inspection conducted on January 21-23,1997, with continued NRC review through February 12,1997, of certain selected activities authorized by NRC License Nos. 48-0984318 and R-74. The purpose of the inspection was to determine -

whether activities authorized by your licenses were conducted safely and in accordance with NRC requirements. At the conclusion of the site inspection, the preliminary findings were discussed with you and members of your staff on January 23,19ht. Our final inspection results and conclusions were discussed with Mr. Ronald Bresell and Dr. Bruce Thomadson during a telephone conference call on February 12,1997, with Darrel Wiedeman of my staff. In addition, several unresolved issues which were identified during the inspection that involved your May 1,1987, request for an exemption to 10 CFR 35.315(a)(8) were discussed and subsequently resolved.

The inspection was an examination of activities conducted under your licenses as they relate to radiation safety and to compliance with the Commission's rules and regulations and with the conditions of your licenses. Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observations of activities in progress.

In addition to the above areas, the inspectors examined actions described in your letters dated September 18,1995 and January 26,1996, regarding a violation found during our October 16 through December 15,1995 inspection of License No. 48-09843-18. Further, we examined actions taken to address a violation found during our September 23,1996 inspection of License No. I 'A. We have no further questions regarding these matters.

Based on the results of thL inspection, the NRC has determined that violations of NRC requirements occurred against License No. 48-09843-18. The violations are cited in the enclosed Notice of Violation (Not;ce). A written response is required. The violations associated with your portable nuclear gauge program are of special concern to the NRC because a single individual was using a portable nuclear gauge during numerous occasions in 1996 and was not specifically approved by the University Radiation Safety Committee.

associated with nuclear gauges and was unaware of the requirements for transporting nuclear gauges. Therefore, in addition to responding to the violations in the enclosed l Notice, please describe your proposed actions for ensuring that all pertinent staff are appropriately trained on your policies and procedures for using and transporting nuclear gauges.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, its enclosure, and your response will be placed in the NRC Public Document Room (PDR).

To the extent possible, your response should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.
