Dear Ms. Connor:

l This is in response to your letter dated November 15, 1978 in which you ,

requested, pursuant to the Freedom of Information Act, copies of 26 '

documents relating to employee overexposures and drum leaks. Your letter was received by the Office of Administration on November 21, _

1978.

Copies of the documents listed in Appendix A, except for the exempt portions of the enclosures to document numbers 1, 2, 4, 6 through 9, and 11 through 21 of Appendix A are being placed in the NRC Public Document Room,1717 H Street, N.W. , Washington, DC for you to review.

Portions of the documents 1, 2, 4, 6 through 9 and 11 through 21 of Appendix A have been deleted in order to withhold the names of individuals 1

who have been exposed to radiation. Because disclosure of the information would constitute a clearly unwarranted invasion of personal privacy, it is being withheld from public disclosure pursuant to exemption (6) of the Freedom of Information Act (5 U.S.C. 552(b)(6)) and 10 CFR 9.5 (a)(6) of the Commission's regulations.

For your information, document 3 is a letter dated February 4,1970 rather than February 3,1970; document 8 is a letter dated February 9, 1971 rather than February 9,1978; document 14 is a letter dated August 13, 1973 rather than August 13, 1972; and document 20 is a letter dated February 4,1976 rather than February 24, 1976 as requested.

Pursuant to CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.

The persons responsible for this denial are the undersigned and John G.

Davis, Acting Director, Office of Inspection and Enforcement.

This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the n eceipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."
