Dear Mr. Knuth:

This is in further response to your letter dated October 5,1978, in which you requested, pursuant to the Freedom of Information Act, access to all documents used by the Commission in its deliberation in establishing the threat level of 10 CFR Part 73.55(a) or those subsequent documents which may be a basis for confirming or modifying this threat level.

Portions of documents 1 through 6,12 and 13 of Appendix A have been classified pursuant to Executive Order 11652 and are being withheld from public disclosure pursuant to exemption (1) of the Freedom of Information Act (5 U.S.C. 552(b)(1)) and 10 CFR 9.5(a)(1) of the Commission's regula-tions. Copies of documents 1 through 6,12 and 13 with exempt portions deleted are already located in the PDR in the file locations indicated on Appendix A.

Portions of documents 7 through 11 of Appendix A contain advice, opinions and recommendations of the staff, and are being withheld from public disclosure pursuant to exemption (5) of the Freedom of Information Act (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.

Copies of documents 7 through 11 of Appendix A with exempt portions deleted are already located in the PDR in the file locations indicated on Appendix A.

Pursuant to 10 CFR 9.11 and 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for the denial of documents 1 through 5 and 7 through 12 of Appendix A are the undersigned and Dr.

Clifford V. Smith, Jr., Director, Office of Nuclear Material Safety and l Safeguards. The person responsible for the denial of the withheld portions of documents 6 and 13 is Mr. Samuel J. Chilk, Secretary of the Commission.

The denials by Dr. Smith and myself may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter.

Any such appeal must be in writing, addressed to the Executive Director 781214024j
