This is in further response to your letter dated September 20, 1978 in which you requested, pursuant to the Freedom of Information Act, two
. documents relating to the evaluation of operating reactor licensees.
We will continue to make every effort to expedite the processing of your request. However, since NRC has not been able to respond to your request within the statutory response time, you may wish to consider this a denial of your request. You should be aware, however, that when f i NRC does respond to your request, you will be given the opportunity to appeal the denial of any documents that are actually withheld from disclosure.
If you consider this a denial of your request, you may, as provided in 10 CFR 9.11, file a written appeal to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555. Your appeal should clearly state on the envelope and in the letter that it is an
