Dear Mr. Kranish:

This is in response to your letter dated September 5,1978, in which you requested, pursuant to the Freedom of Information Act, the following documents as described in the August 11, 1978 Weekly Information Report:

1 - Proliferation Resistent Assessment of Three Nuclear Power Systems 2 - Study of Price-Anderson Indemnity for Radioisotoper 3 - List of 28 foreign technical notification addresses ud description of meeting plans Your request was received by the Office of Administration on September 7, 1978.

Item 1 above is a draft paper prepared by the U.S. Arms Control and Disarmament Agency, and has been referred to that agency for review and direct response to you.

With respect to item 2, document 1 of Appendix A is being placed in the NRC Public Document Room (PDR),1717 H Street, N.W. , Washington, D.C.

Document 1 of Appendix B contains NRC's preliminary draft calculations being developed to calculate the amount of radioisotope release that would result in a given amount of damage. Document 2 of Appendix B is a draft ORNL report which forms the bases for the calculations in document 1.

These documents are being withheld from public disclosure pursuant to Exemption (5) of the Freedom of Information Act (5 U.S.C. 552 (b)(5))

and 10 CFR 9.5(a)(5) of the Commission's regulations. We expect the ORNL report to be printed in November 1978, and will place a copy of the report in the POR at that time.

With respect to item 3, documents 2 and 3 listed on Appendix A are being placed in the PDR.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the ,

public interest. The persons responsible for this denial are the under-signed and Dr. Clifford V. Smith Jr., Director, Office of Nuclear Material Safety and Safeguards.

This denial may be appealed to the Commission's' Executive Director for l Operations within 30 days from the receipt of this letter. . As provided l in 10 CFR 9.11, any such appeal must ce in writing, addressed to the l Executive. Director for Operations, U.S. Nuclear Regulatory Commission, -i Washington, D.C. 20555, and should clearly state on the envelope and in- l the letter that it is an " Appeal from an Initial FOIA Decision."- i l
