Dear Betty:

' I would like to request urgent handling and approval of the above referenced license applications.

Early this year, a delegation of people from Oremet-Wah Chang visited Northwest-Institute for Nonferrous Metals in China. As a result of that visit, the Chinese invited us to send a sample of Zircaloy trex tubing to them for testing. In February, I applied for an NRC license for the sample material. I later discovered that the license was not moving because someone who had reviewed the license felt that the amount'of material requested was excessive for a sample application. We then sent a letter of explanation showing th. need for the large sample.

This summer we were also successful in securing a much larger order from Nonhwest Institute for Nonferrous Metals for Zircaloy tubing to be used as fuel cladding tubes in commercial power stations. I sent the license application for that order on July 28,1999.

If we are unable to get these expon licenses approved before October 30,1999 )

our agreement with the customer becomes void, and we will lose this business to the French zirconium manufacturer, CEZUS. This order is extremely imponant to our company. We would greatly appreciate any help you can give us.

3. Safeguarded and unsafeguarded nuclear fuel cycle activities, including research on or development, design, manufacture, construction, operation or maintenance of any of the following facilities, or components for such facilities:
1. Facilities for the chemical processing ofirradiated special nuclear or source material;
11. Facilities for the production of heavy water; III. Facilities for the separation ofisotopes of source and special nuclear material; or IV. Facilities for the fabrication of nuclear reactor fuel containing Plutonium.

That written authorization will be obtained from the bureau of export administration prior to reexporting the items, unless they are destined to Canada or would be eligible for export to the country of destination under NLR ( No License Required).

6. Packing:

To be packed suitable for long distance ocean freight transportation and to change of climate, well protected against moisture and shocks. The Sellers shall be liable for any damage of the commodity and expenses incurred on account ofimproper packing and for any rust attributable to inadequate or improper protective measures taken by sellers in regard to the packing. The seller shall mark on each package with fadeless paint the package number, gross weight, net weight, measurement and shipping mark.

7. Payment Terms Payment will be made by Irrevocable Letter of Credit and detailed conditions will be stipulated in each specified order.
8. USA export license issue Considering that acquiring an export license is a current issue, Wah Chang agrees that if an export license is not available by October 31,1999 NWZ has the option to purchase the currently due increment from another and this event Wah Chang is relieved from this increment.

In the case that for the next scheduled requirement does not have an export license available the above case applies. In these cases the'!ast moment for release is 12 weeks prior scheduled shipment date.

Included in this package is our check for $4,800.00, a Statement by Ultimate Consignee and Purchaser, an End Use Statement listing the power stations which will receive the cladding tubes, an NSG Certification Statement, and a copy of our Zr-4 Trex Purchasing Agreement with Nonhwest Zirco-Cladding Co.

l As stated on our previous license application for tubes to be sent to China, Nonhwest i Institute for Nonferrous Metal Research is the parent company of Nonhwest Hi Tech Corporation and Nonhwest Zirco-Cladding. Nonhwest Hi Tech does the actual purchasing, the tubes will be sent to Nonhwest Zirco-Cladding for processing. They are all physically located in the same complex.

According to our salesperson, Mike Moyer, Nonhwest Institute for Nonferrous Metal Research is the parent company of Northwest Hi Tech Corporation and Northwest Zirco-Cladding.

Nonhwest Hi Tech does the actual purchasing, the tubes will be sent to Nonhwest Zirco-Cladding for processing and the results will be given to Northwest Institute for Nonferrous Metal Research for evaluation. They are all physically located in the same complex.
