Failure to Perform 10 CFR 50.59 Evaluation for Main Feedwater System Sparger Nozzle Damage

Description

The inspectors identified a Severity Level IV non-cited violation of 10 CFR 50.59 , Changes, Tests, and Experiments, for the licensees failure to provide a written safety evaluation for the determination that operation with compensatory measures for damaged feedwater sparger nozzles did not require a license amendment pursuant to 10 CFR 50.90, Application for amendment of license, construction permit, or early site permit. Specifically, the licensee failed to recognize that compensatory measures prohibiting operation in single loop conditions required technical specification changes, and as such required prior NRC approval.
