Title

Failure to modify the Diesel Oil Storage Tank Overflow Line as Required by a Fire Protection License Requirement

Description

Inspectors identified a Severity Level IV violation of 10 CFR 50.48(c), National Fire Protection Association Standard NFPA 805, for the licensees failure to modify the Unit 2A and 2B diesel oil storage tank (DOST) overflow lines as required by a fire protection license requirement. The issue was entered into the sites corrective action program as AR 2140024. The licensees failure to notify the NRC of changes to a licensed activity that was stipulated in the fire protection license condition (Table S-1) was a performance deficiency. The inspectors determined the PD was more than minor because the licensee failed to notify the NRC that the Unit 2 DOSTs overflow lines would not be modified; and, subsequently failed to request an exemption from the requirements of NFPA 30. Traditional enforcement was applied because the PD impacted the ability of the NRC to perform its regulatory oversight function. In accordance with the NRC Enforcement Manual, Part II, Section 2.2, Actions Involving Fire Protection, the inspectors evaluated this finding to be a Severity Level IV violation. The inspectors determined that a cross-cutting aspect was not applicable because the issue was associated with a traditional enforcement violation.
