September 2, 2008 NOTICE OF CONFERENCE CALL (Conference Call To Discuss Matters Relating To Scheduling Oral Argument)

As the parties were informally advised on August 28, 2008, the Board is contemplating holding an oral argument relating to the issue the Commission referred to the Board in an order dated August 21, 2008.

1 On Friday, September 5, 2008, at 1:00 PM, this Board will convene a conference call with counsel to the parties to discuss scheduling and administrative matters

relating to the oral argument. Prior to the conference call, the Board

=s law clerk will provide counsel an outline of the topics that will be discussed.

No later than 3:00 PM on September 3, counsel should notify Karen Valloch B who is a member of the Licensing Board Panel

=s administrative staff, and who may be reached via e-mail at karen.valloch@nrc.gov B of the number of separate locations from which you and any colleagues or associates will be calling, so that she may reserve an appropriate number of

phone lines. After hearing from counsel for each party, Ms. Valloch will provide instructions for

participating in the call, including the telephone number and pass code. To assure that the conference call commences promptly, all par ticipants should access the telephone number a few minutes before the conference is scheduled to begin.
