Request for Scoping Comments - Virgil C. Summer Nuclear Station
The U.S. Nuclear Regulatory Commission (NRC) is conducting a review of the environmental effects of renewing the operating license for Virgil C. Summer Nuclear Station, Unit 1 (Summer).
In accordance with 36 CFR 800.8(c), the NRC i ntends to comply with Section 106 of the National Historic Preservation Act of 1966 through the National Environment Policy Act of 1969 (NEPA) process. The purpose of the attached letter is to initiate Section 106 consultation with the South Carolina State Historic Preservation Office. The NRCs notice of intent to conduct scoping regarding the Summer application has been published in the Federal Register: 88 FR 75627.

Dear Kim Conway:
Thank you for the letter of November 3, 2023 from Theodore B. Smith, which we received on November 3, 2023, initiating consultation on the above referenced undertaking and requesting scoping comments for the National Environmental Policy Act (NEPA) process. We also received three maps as supporting documentation for this undertaking. The State Historic Preservation Office (SHPO) is providing comments to the Nuclear Regulatory Commission (NRC) pursuant to Section 106 of the National Historic Preservation Act and its implementing regulations, 36 CFR 800. Consultation with the SHPO is not a substitution for consultation with Tribal Historic Preservation Offices, other Native American tribes including those with state recognition, local governments, or the public. We understand that the NRC intends to comply with Section 106 through the NEPA process.
The letter states that the NRC staff has determined that the Area of Potential Effect (APE) is the area at the nuclear power plan site and its immediate environs that may be impacted by ongoing routine maintenance and operational activities during the subsequent license renewal period.
We understand that this is the red boundary shown on Enclosures 2 and 3. (It would be helpful for the legend to define the APEs.) In addition the letter states the APE may extend beyond the immediate V.C. Summer environs if DESC maintenance and operational activities affect offsite historic properties and is shown as the dotted line on Enclosure 3.
We compared these APEs to those proposed in the Environmental Report prepared by Dominion Energy, Appendix E, page E-3-194, which we received in August 2023. It provided definitions of an aboveground APE and a separate archaeological APE. It appears that the archaeological APE defined in the Environmental Report as the 2,200 acre VCSNS site matches the APE shown
on Enclosures 2 and 3. The Environmental Report defined the aboveground APE as the VCSNS property and everything within a 6 mile radius, which appears to match the area shown by the dotted line in Enclosure 3. We concur with these APEs as described by NRC but request that the APEs be defined and illustrated on the maps
Our office previously reviewed and provided comments to Dominion Energy on a cultural resources survey titled, V.C. Summer Nuclear Station Architectural Survey and Evaluation, Fairfield County, South Carolina, dated March 2023 conducted by SEARCH. The final report copies, survey forms and photographs and GIS shapefiles have been provided to our office.
The survey recorded 39 buildings and structures constructed prior to 1984 at the V.C. Summer Nuclear Station. The report recommended that the recorded buildings and structures do not meet the criteria for listing in the National Register of Historic Places.
Our office concurred with this assessment at the current time, as the buildings are less than fifty years old and the National Register Criteria Consideration G for properties that have achieved significance within the last fifty years exclude[s] properties that achieved significance within the last fifty years unless they are of exceptional importance. Our office recommended and Dominion Energy agreed to re-evaluate the VC Summer Nuclear Complex for eligibility in the National Register of Historic Places if a future subsequent license renewal were pursued. This would take place sometime after 2042.
