USER NEED FOR RULEMAKING FOR THE HOLTEC HI-STORM UMAX STORAGE SYSTEM CERTIFICATE OF COMPLIANCE NO. 1040, AMENDMENT NO. 4 The purpose of this communication is to request support for rulemaking activities in the Division of Fuel Management (DFM) for the following Title 10 of the Code of Federal Regulations (10 CFR) Part 72 licensing action:

1. Changes to 10 CFR 72.214 rule text (changes appear in bold):

By letter dated September 28, 2018 (Agencywide Documents Access and Management System (ADAMS) Accession Number ML18285A820), as supplemented on May 21, 2019 (ADAMS Accession Number ML19144A146), November 1, 2019 (ADAMS Accession Number ML19311C514), December 20, 2019 (ADAMS Accession Number ML20002A425), March 30, 2020 (ADAMS Accession Number ML20104C014), and April 13, 2020 (ADAMS Accession Number ML20111A237), Holtec International submitted an amendment request to the U.S. Nuclear Regulatory Commission (NRC) for the HI-STORM UMAX Storage System Certificate of Compliance (CoC) No. 1040. The proposed changes include the following:

Change #1 - Update the Technical Specifications (TS) for Radiation Protection regarding the Dose Rate Limit for the Vertical Ventilated Module Lid.

Change #2 - Update the TS for the Vent Blockage Limiting Condition for Operation.

Change #3 - Add a Type 1 version of the MPC-37.

3. The proposed CoC, TS, and preliminary safety evaluation report (PSER) have been placed in ADAMS (see references below) and are available for your use in the rulemaking package. DFM will designate these documents as Official Agency Records after the Executive Director for Operations has approved the package (ADAMS Package No. ML20161A087.

The Office of the General Counsel has reviewed this memorandum with its referenced documents and has no legal objection to its contents.
