OF EXEMPTION ORDER - REQUEST FOR ADDITIONAL INFORMATION (TAC NO. M98049)

Dear Mr. Feigenbaum:

The NRC staff has been reviewing the " Petition of Great Bay Power Corporation for Partial Reconsideration of Exemption Order" (appeal), submitted by Great Bay Power Corporation (GBP) on February 21, 1997, through counsel Shaw, Pittman, Potts & Trowbridge. The appeal seeks partial reconsideration of the l Commission's temporary exemption from the requirements of 10 CFR 50.75(e)(2)

L with respect to G8P. Specifically at issue is the staff's finding that GBP l

does not meet the NRC's definition of electric utfifty.

Central to the definition of electric utfifty is the concept that an electric utility is able to recover its costs of generating electricity through rates

set by an independent regulatory body (or itself if so authorized). So that all pertinent information in regard to GBP's recovery of costs is before the staff during its review of GBP's appeal, the staff is offering GBP an opportunity to submit any additional information that would demonstrate GBP's

. ability to recover its cost of generating electricity at Seabrook Station.

Please submit any such information no later than June 6,1997. '
