Dear Mr. Marshall:
This is in response to your letter of October 10,1997 regarding the Nevada Administrative l- - Code 450.120(3)(a). This Nevada regulation is the equivalent of 10 CFR 30.12. " Persons using l byproduct material under certain Department of Energy and Nuclear Regulatory Commission L contracts." This provklon is a Category B rule under the new adequacy and compatibility policy L statenent approved N the Commission by Staff Requirements Memorandum dated June 30, 1997. Category B rules have significant direct transboundary implications and should be essentially identical to that of the NRC.
l in addition, you requested our interpretation of whether the language, "... at a United States Govemment owned or controlled site...." in 10 CFR 30.12 and the equivalent in Nevada's regulation NAC 459.120(3)(a) is interpreted to mean " sites under exclusive Federal jurisdiction."
The language " sites owned or controlled by the United States Govemment" does not necessarily mean that the site is under exclusive Federaljurisdiction. (An area of exclusive Federal jurisdiction is an area over which the Federal Government exercises legal control without interference from the jurisdiction and administration of State law.) The exemption provided to DOE prime contractors by 10 CFR 30.12 states,"... any prime contractor of the Department is exempt from ... the regulations in this part to the extent that such contractor, under his prime contract with the Department manufactures, produces, transfers, receives, acquires, owns, possesses, or uses byproduct material for: (a) The performance of work for the
- Department at a United States Govemment-owned or controllad site, incluoing the transportation of byprocluct material to or from such site and the performance of contract services during temporary interruptions of such transportation; (b) Research in, or development, manufacture, storage, testing or transportation of. atomic weapons or components thereof; or (c) The use or operation of nuclear devices in a United States Govemment owned vehicle or vessel." Thus, the DOE prime contractor exemption is not limited to exclusive Federal jurisdiction areas but includes areas where the site is "... United States Govemment-owned or controlled...." pei 10 CFR 30.12(a)
