Dear Mr. Eddy:

This in response to your letter dated April 21, 1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), a copy of report number 1-84-014 regarding allegations concerning Nine Mile Point Unit 2.

Copies of this requested report and the accompanying exhibits have been made available for public inspection and copying at the NRC Public Document Room (PDR) in Washington, DC 20555. These records are filed in the PDR docket file for the Nine Mile Point plant. We understand that an NRC staff member has provided a copy of the report to a member of your organization. Therefore, we are taking no further action on your request. In the event you may be interested in obtaining copies of any of the exhibits, we are enclosing a copy of the notice that provides procedures for obtaining copies of records at the PDR.

Copies of the report and exhibits will also be available at the NRC's local Public Document Room (LPDR) for the Nine Mile Point plant. The LPDR is located at the address noted below with the name of the librarian who can provide assistance regarding inspection of the records.

  • Mr. Eddy from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Commission, U. S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision." We note in this regard that there is a penting i lawsuit, Ryan v. Nuclear Regulatory Commission, D.D.C. 86-1553, regarding the releas? of the 01 report and exhibits.
