SUPPORTING AMENDMENT NO. 25 TO FACILITY LICENSE NO. R-77 :
STATE UNIVERSITY OF NEW YORK AT BUFFALO DOCKET NO. 50-57
1.0 INTRODUCTION
By letter dated June 23,1998, as supplemented on February 17,1999, the State University of New York (SUNY) at Buffalo (the licensee) requested their technical specifications (TS) be revised to show their proposed organizational structure and to change a couple of titles in that structure. Also, the meeting frequency of the Reactor Decommissioning Safety Committee was changed from a frequency of three to two meetings per year.
2.0 EVALUATION The organizational structure in figure 1 of the TS was revised to change all references from
" Acting Director of Environmental Health and Safety" to Director of Occupational and Environmental Safety Services (OES). Three separate university departments, Environmental Health and Safety, Radiation Protection Services, and Buffalo Materials Research Center (BMRC), have been merged into a single department, namely OES. All staff members have been retained. Organizational changes made pursuant to the merger include the following.
The BMRC Director (formerly called the Director of BMRC, see below for discussion on the change of title) now has additional responsibilities as Associate Director of OES. His prior authorities and responsibilities are maintained.
An Emergency Planning and Preparedness Coordinator position has been created. This individual will support emergency planning related to the reactor program, as well as other campus operations. However, the Director of OES will retain primary responsibility for reactor
. emergency planning, The licensee believes that the merger of the three safety related departments will eliminate some redundant costs (principally administrative), build a stronger team environment to support the reactor program, and will help retain key staff members by allowing them to assimilate into new roles within the organization.
The staff finds these changes acceptable.
The title of Director of BMRC has been changed to read BMRC Director. The change was made in TS 11.2.2 and 13.3. This change is for the purpose of clarity. The title of Director is

t commonly used throughout the University at Buffalo. By placing BMRC before Director, j consistency is maintained and potential confusion over title is avoided.
The staff finds this change acceptable.
The meeting frequency of the Reactor Decommissioning Safety Committee (RDSC) has been changed from three meetings to two meetings per year in TS 11.5.1(4). When the current specifications were submitted to the NRC the licensee anticipated that there would be a higher level of activity at the BMRC. They currently do not expect to ship the reactor irradiated fuel off site for several years, and a period of moderate activity is expected. The licensee states that l they have improved the quality of this committee by recruiting members from a local nuclear l utility and a Department of Energy waste project. They do not wish to discourage committee I
members by requiring them to attend meetings if there are no substantive issues on the agenda.
l The staff finds this acceptable and notes that it is within the recommendations of ANSI /ANS-15.1-1990, Section 6.2.2.

! i 3.0 ENVIRONMENTAL CONSIDERATIOE Tnis amendment changes recordkeeping, reporting, or administrative procedures or J requirements. Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10). Pursuant to 10 CFR 51.22(b), no environmentalimpact statement or environmental assessment need be prepared in connection with the issuance of this amendment.
4.0 CONCLUSION
The staff has concluded, based on the considerations discussed above, that (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, and (2) such aciMties will be conducted in compliance with the Commission's regulations and the issus.,ce of this amendment will not be inimical to the common defense and security or the health and safety of the public.
