SUBJECT:

CONTACT WITH U.S. DEPARTMENT OF TRANSPORTATION REGARDING ALLEGATION OF SUSAN BYERS LOTT

3. REASON FOR CONTACT a her deposition regarding the Chem-Nuclear low-level waste disposal facility at Barnwell, South Carolina, Mrs. Lott made allegations which appeared to be within the jurisdiction of DOT. She also talked about an investigation of Chem-Nuclear performed by DOT in 1978. DOT was contacted to apprise them of the allegations made by Mrs. Lott and to determine the purpose and findings of the DOT investigation.-

SUMMARY

OF CONTACT On April 3,1980, I contacted Mr. William L. Barrow, Director, Office of Motor Carrier Safety, Federal Highway Administration, U.S. Department of Transportation, Atlanta, Georgia. I informed Mr. Barrow that Mrs. Lott had specifically alleged. illegal overweight shi at illegal hours (during hours of darkness)pments, legal overveight and excessive driving times, shipments and that drivers' logs had been changed to coverup these violations.

Mr. Barrow stated that DOT did not regulate overveight trucks and that jurisdiction rested with the States regarding such matters. I told Mr. Barrow that we would forward appropriate pages of Mrs. Lott's deposition '

regarding falsification of drivers' logs for whatever action they deemed appropriate. Mr. Barrow pointed out that DOT regulatione only require that.

these loss be retained for one year.

With regard to.the DOT investigation alluded to by Mrs. Lott, Mr. Barrow stated that-DOT had not done an investigation of Chem-Nuclear. He informed en that during 1976 - 1978 DCT had a program emphasis on radioactive waste shipments and that he himself had requested permission from Chen-Nuclear to enter their private property (Barnwell disposal site) to inspect shipments coming into the site. Mr. Barrow stated that the inspections were not specifically aimed at chem-Nuclear vehicles and drivers, nor limited to

.them. Vehicles-and drivers of other companies which entered the site were also inspected. Mr. Barrow specifically stated that the inspections were not the result of any alleged or suspected violations, but were a part of DOT's routine inspection program. Mr. Barrow indicated that some drivera had been cited as a result of these inspections. .,
