SEABROOK STATION, UNIT NO.1 - REOUEST FOR WITHHOLDING INFORMATION FROM PUBUC DISCLOSURE (TACS NOS. M98049 AND l M99072)

Great Bay Power Corporation submitted additionalinformation related to Great Bay's petition for partial reconsideration of the NRC's January 22,1997, exemption through its attorneys Shaw, Pittman, Potts & Trowbridge by letters dated June 4 and 16,1997. The i June 4 letter included your affidavit dated June 3,1997, requesting that certain financial Information included in Exhibit I of the June 4 letter be withheld from public disclosure l_ pursuant to 10 CFR 2.790.

In the affidavit, you indicated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

(1) Great Bay holds in confidence revenue and cash flow projections as well as projected sales price information and cash outlays for the cost of generating-electricity; 4

(2) The materialis of the type customarily held in confidence by Great Bay and is not customarily disclosed to the public; (3) The information sought to be withheld from public disclosure is not available in public sources; and (4) The information is commercially sensitive, and if available to others could place 1 Great Bay at a significant competitive disadvantage in future sales negotiations and cause substantial commercial harm.

We have reviewed your application and the material based on the requirements and criteria of _10 CFR 2.790, and, on the basis of Great Bay Power Corporation's statements, have determined that the information sought to be _ withheld contains trods secrets or proprietary commercial information.=

Therefore, Exhibit I to your letter dated June 4,1997, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

YourJune 16,1997, letter stated in a footnote that Exhibit A contains similar financial information of a sensitive, confidential nature, and that Great Bay's June 3 request for withhold 3ng information from public disclosure is equally applicable. However, the required affidavit was not included. The information will be withheld temporarily from public disclosure pending receipt of the required affidavit and our related determination. Please -

submit the affidavit by September 18,1997.
