NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION l I

Licensee: Philadelphia Electric Company (EA 89-126)

(Limerick Nuclear Generating Station)

Docket Nos. 50-352, 50-353 J

Subject:

PROPOSED IMPOSITION OF CIVIL PENALTY - $75,000 ]

.)

This is to inform the Comission that a Notice of Violation and Proposed  ;

Imposition of Civil Penalty in the amount of Seventy-Five Thousand Dollars

($75,000) will be issued on or about August 10, 1989 to Philadelphia Electric 1 Company. This action is based on: (1) the inability of the operations staff to effectively utilize the Emergency Action Level Event Classification guides to properly escalate emergency classifications and make appropriate Protective Action Recommendations, and (2) the failure to promptly correct deficiencies in the emergency preparedness program which were identified during previous Nuclear Quality Assurance audits. The adjustment factors in the Enforcement Policy were considered and, after considering escalation for NRC-identification of the violations, mitigation for the licensee's corrective actions, and escala-tion for prior notice of the violation involving failure to correct identified deficiencies, and the mitigation for good overall performance in other functional areas, the base amount of the civil penalty was increased by 50%.

) It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice August 10, 1989 Telephone Notification of Licensee August 10, 1989 The State of Pennsylvania will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
