We have received your letter dated July 12, 1988, in response to the Notice of

Violations and Proposed Imposition of Civil Penalty sent to you with our letter dated June 13, 1988. Our letter and Notice described violations identified during the NRC inspection conducted during the period February 19 - March 18, 1988.

l In your response to the Notice, you (1) provided a check for $12,500 in full payment of the civil penalty; and (2) denied one of the seven violations (Item E '

in the Notice). Af ter careful consideration of your response, and for the reasons discussed herein, we have concluded that the violation denied in your response did, in fact, occur as stated, and sufficient basis was not provided for retraction of the violation.

With regard to Item E, you stated in your reply that the cited license section was not considered to apply to non-routine operations such as vacuum cleaner cleaning as discussed in urdocumented conversations with NRC licensing personnel. We are not aware of the undocumented conversations with NRC licen-sing personnel. Furthermore, whether or not this is a routine or non-routine operation is not the controlling issue. Due to improper hood face velocity measuretrents made by your staff, the hood was not effective as an engineering control device in controlling the generation of airborne contamination.

We have reviewed your corrective actions described in your response concerning the individual violations set forth in the Not :e and your plans for (1) per-forming an assessment of your radiation protecuen prooram, particularly, with regard to your performance iriprovement program, and (2) instituting appro,nriate corrective measures to upgrade the program based on the assessment findings.

No further response is reouired. These actions will be examined during a future inspection of your licensed facility.
