Dear Mr. Stolz:

Under separate cover, we are transmitting three (3) original and forty (40) conformed copies of an application for Amendment to Facility Operating License No. NPF-3 for the Davis-Besso Nuclear Power Station Unit No. 1.

This application requeste that the Davis-Besse Nuclear Power Station Unit 1 Technical Specificaticas, Appendix A, be revised to reflect the changes attached. The proposed changes involve Section 3.6.4.2, 4.6.4.2 and Bases. The attached identify the proposed change and its safety evaluation and significant hazard consideration for the deletion of the requirement for containment recirculating fans.

This license amendment is being requested on an emergency basis. The justification for an emergency request is as follows:

Sequence of Events

1. On January 5, 1984 a Containment Recirculation Fan tripped.

The cause could not be determined since the fan is located inside containment. This placed Davis-Besse in Action Station 3.6.4.2 which requires the fan be fixed'within 30 days or be placed in Mode 3.

2. Nuclear Engineering began generating a request to remove the Containment Recirculation Fans from the Technical Specific-ations. This request is attached and technical justification s for the request is provided. O
3. On January 8, 1984 Davis-Besse tripped due to an unrelated k' \

4. On January 9,-1984 the Station Review Board (SRB) approved the

-proposed License Amendment.

5. On January 10, 1984 the Company Nuclear Review Board (CNRB) approved the proposed License Amendment.
6. On January 12, 1984 it was determined that justification for an emergency Technical Specification existed.

Reasons for an Emergency Hequest

1. Toledo Edison's share of the Davis-Besse plant is 428 MW and is approximately 33% of the current TED system demand which is 1270 MW. The unavailability of Davis-Besse coupled with the fact that our Bay Shore Unit 4 (215 MW) is offline, has resulted in the need for TED to purchase 300 MW. This need is projected to continue until Davis-Besse is restarted.
2. At this time there are two restraints to startup. The first is the condensor to turbine boot seal repair and the second is Technical Specification Section 3.0.4 which is appropriate as a result of our inoperable containment recirculation fan. It is currenLly projected that the seal repairs will be completed in time to support a Tuesday, January 17, 1984 startup. Thus, on January 17, 1984 the only restraint to startup will be the .

inoperable containment recirculation fan. Emergency action on the attached License Amendment Request is required to remove the restraint.

Based upon -Lhe above information, we believe that Toledo Edison has acted expeditiously in filing this amendment request. Furthermore, in recognition of the power demand situation in our area, we believe this request should be handled on an emergency basis.

This amendment request involves a change of Class III type. Enclosed is a check for $4,0d0 as requested by 10CFR170.22.
