_________________x LICENSEES' RESPO!!SE TO WEST BRANCII CONSERVATION ASSOCIATION APPLICATION Licensees hereby reply to the West Branch Conservation Association's " Application for Reinstatement of Contention 2.2(d) and West Branch Conservation Association's Objection to Restatement of 2.2(b) dated November 4, 1982" (November 4 WBCA Application). The WBCA Application asks the Board to reconsider two actions it took with regard to contentions under Commission Question 2. First, WBCA seeks the re-instatement of former Contention 2.2(d) which the Board eliminated as an issue in this proceeding in its October 1, 1982 !!emorandum and Order (October 1 Order). Second, 8212140423 021209 DR ADOCK 050002g

WBCA objects to the restatement in the October 1 Order of new contention 2.2(b). WBCA objects to the restated contention because, though it has been assigned lead responsibility with regard to this contention, it does not intend to present testimony on the contention.

Licensees oppose WBCA's request for the re-instatement of former Contention 2.2(d). Licensees believe that the Board's conclusion that the former con-i

, tention " fails to meet the two-pronged test" for ad-ditional proposed safety measures under Commission Question 2 and that "

it would be of minimal importance in answering the Commission's question" (October 1 Order at 20) is correct. As noted by the Licensees and Staff at the November 3, 1982 pre-hearing conference (Tr. 4638-99), neither in its October 13 " Reply to Memorandum and Order of October 1, 1982" nor in its oral presentation at the November 3, 1982 pre-hearing conference, did WBCA offer any additional information which would justify reinstating former Contention 2.2(d). Accordingly, the Board's decision not to reinstate this contention (November 15 Memorandum and l Order at 13-14) was proper. No new argument is offered by the November 4 WBCA Application which would warrant any change in the Board's conclusions as set forth in the October 1 and November 15 orders. The WBCA November 4 l .

Application offers neither evidence of a breakdown of quality assurance during the construction and licensing of the Indian Point plants, nor a rational rejoinder to the Board's conclusion that specific quality assurance issues should be handled by the Commission's Office of Inspection and Enforcement rather than litigated in this proceeding (October 1 Order at 23-24).

With regard to WBCA's objection to restated Contention 2.2(b), Licensees believe that for the reasons stated in their December 1 Motion to Dismiss 1

Certain Contentions, WBCA's decision not to pursue this contention mandates its dismissal.* The November 4 WBCA Application adds support to Licensee's motion when it states that " [WBCA ] never defended 'in situ annealing of the pressure vessel and [has] no intention of doing so. We do not wish to revise the technical specifica-tions to reduce the probability of pressurized thermal Shock.'" WBCA Application at 1.
