We have reviewed the proposed revisions to the Iowa Radiological Health Rules, in the Iowa Administrative Code (IAC) 641-37(136C) Physical Protection of Category 1 and Category 2 Quantities of Radioactive Material; 641-38(136C) General Provisions for Radiation Machines and Radioactive Materials; 641-39(136C) Registration of Radiation Machine Facilities, Licensure of Radioactive Materials, and Transportation of Radioactive Materials; 641-40(136C)

Standards for Protection Against Radiation; 641-41.2(136C) Use of Radionuclides in the Healing Arts; 641-41.5 (136C) Radiation Safety Requirements for Industrial Radiographic Operations, received by our office on January 16, 2020. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2018-1, 2018-2, 2018-3, 2019-1, and 2019-2 as identified in the enclosed State Regulation Status (SRS) Data Sheet.

We discussed our review of the regulations with Randy Dahlin on February 14, 2020.

As a result of our review, we have four comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. Under our current procedure, a finding that the Iowa regulations meet the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final Iowa regulations. However, we have determined that if your proposed regulations were adopted, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when the proposed regulations are adopted and published as final regulations, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the final changes, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet summarizes our knowledge of the status of other Iowa regulations, as indicated. Section 41.2(81)c(3) states, Has obtained written attestation that the individual has satisfactorily completed the requirements in paragraphs 41.2(81)(c)(1) and (2), and is able to independently fulfill the radiation safety-related duties as an authorized user for medical uses under 41.2(37).

Iowa omits the phrase, for oral administration of less than or equal to 1.22 gigabecquerels (33 millicuries) of sodium iodide I-131 for such that the above statement should read, Has obtained written attestation that the individual has satisfactorily completed the requirements in paragraphs 41.2(81)(c)(1) and (2),

and is able to independently fulfill the radiation safety-related duties as an authorized user for oral administration of less than or equal to 1.22 gigabecquerels (33 millicuries) of sodium iodide I-131 for medical uses under 41.2(37).

Iowa needs to make the above changes in order to meet the Compatibility Category B designation assigned to 10 CFR 35.392.

2 41.2(82) § 35.394 2018-1 B Training for the oral administration of sodium iodide I-131 requiring a written directive in quantities greater than 1.22 gigabecquerels (33 millicuries)

STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS Section 41.2(82)c(3) states, Has obtained written attestation that the individual has satisfactorily completed the requirements in paragraphs 41.2(82)(c)(1) and (2), and is able to independently fulfill the radiation safety-related duties as an authorized user for medical uses under 41.2(37).

Iowa omits the phrase, for oral administration of greater than or equal to 1.22 gigabecquerels (33 millicuries) of sodium iodide I-131 for such that the above statement should read, Has obtained written attestation that the individual has satisfactorily completed the requirements in paragraphs 41.2(82)(c)(1) and (2),

and is able to independently fulfill the radiation safety-related duties as an authorized user for oral administration of greater than or equal to 1.22 gigabecquerels (33 millicuries) of sodium iodide I-131 for medical uses under 41.2(37).

Iowa needs to make the above change in order to meet the Compatibility Category B designation assigned to 10 CFR 35.394.

3 41.2(89) § 35.396 2018-1 C Training for the parenteral administration of unsealed byproduct material requiring a written directive Section 41.2(89)(a)3(2) states, A residency program director who affirms in writing that the attestation represents the consensus of the residency program faculty where at least one faculty member is an authorized user who meets the requirements in 41.2(59), 41.2(75) or

Iowa needs to replace the reference to 41.2(59) with a reference to 41.2(69), and include NRC requirements in addition to Agreement State and Iowa regulations, so that the above statement reads, A residency program director who affirms in writing that the attestation represents the consensus of the residency program faculty where at least one faculty member is an authorized user who meets the requirements in 41.2(69), 41.2(75) or 41.2(89), or equivalent Agreement State or NRC requirements, Iowa needs to make the above change in order to meet theCompatibility Category B designation assigned to 10 CFR 35.396.

4 41.2(52) § 35.610 2018-1 H&S Safety procedures and instructions for remote afterloader units, teletherapy units, and gamma stereotactic radiosurgery units Section 41.2(52)g states, A copy of the procedures required in 41.2(52)d(2) shall be retained for three years.

10 CFR 35.2610 states, A licensee shall retain a copy of the procedures required by §§ 35.610(a)(4) and (d)(2) until the licensee no longer possesses the remote afterloader, teletherapy unit, or gamma stereotactic radiosurgery unit.

Iowas requirement is less restrictive.

STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS Iowa needs to change 41.2(52)g such that it states, A copy of the procedures required in 41.2(52)d(2) shall be retained until the licensee no longer possesses the remote afterloader, teletherapy unit, or gamma stereotactic radiosurgery unit.

Iowa needs to make the above change in order to meet the Compatibility Category H&S designation assigned to 10 CFR 35.610.

5 37.23(2)b § 37.23(b)(2) 2018-3 B Access authorization program 2019-1 requirements Iowa needs to indicate that the oath and affirmation certifications required in 37.23(2)b should be sent to their agency.

Iowa needs to make the above change in order to meet the Compatibility Category B designation assigned to 10 CFR 37.23(b)(2).
