Millstone Draft Environmental Impact Statement

Dear Mr. Emch:

Thank you for your reply on February 7, 2005 to our January 24, 2005 email request for information concerning the NRC's draft Environmental Impact Statement ("EIS") prepared in the Millstone relicensing matter.

We believe the record of proceedings on January 11, 2005 reflects an aggressive effort on the part of NRC staff in attendance to create the impression that feedback from the public is welcome on this project and questions and communications with NRC staff encouraged.

W regret that your two-week delay in responding to our email, particularly in light of the NRC-created deadline of March 2, 2005 for written public comment, belies this impression.

We also regret that you have apparently decided to delay responding to the request until on or after February 9, 2004 based upon communications from the NRC's Freedom of Information staff.

To the extent that information responsive to our request was readily available to you yet withheld, any delay in providing such information has served to thwart public participation in the NEPA process.

This delay has caused actual prejudice to the Connecticut Coalition Against Millstone in obtaining needed information from the NRC in order to prepare meaningful comments in a timely fashion.

Turning to your comments emailed on February 7, 2005, we respond as follows:

Your email contains the following comment:

"I believe much of the information you requested is already available to you on the NRC website or in the Millstone DSEIS (NUREG-1437, Supplement 22)."

We believe this statement is disingenuous. First, our request for information derives from omissions in the DSEIS. If the information we seek is available on the NRC website, please simply provide the pertinent website address.

As you doubtless know, the NRC's "ADAMS" system, designed for ease of public access to information at the NRC, has been unavailable for some months and remains unreliable.

Your email contains the following comment:

"Also, you are on our mailing list; therefore, we sent you the requests for additional information and other documents pertinent to the review process."

It is correct that you previously provided us with a set of Requests for Additional Information. Our January 24, 2005 letter simply requests "all" RAls pertinent to the draft Environmental Impact Statement. (Our January 24, 2005 letter simply asked for 'all Requests for Additional Information submitted to the NRC to the licensee and all reports, documents, emails and other correspondence generated and received therefrom." See below, a listing of the items requested in our January 24, 2005 communication.) If there have been no additional RAls issued pertinent to the draft Environmental Impact Statement, please so advise.

We await a complete and forthright response to our request.

(1) All Requests for Additional Information submitted by the NRC to the licensee and all reports, documents, emails and other correspondence generated and received therefrom.

(2) Please identify the names of all officials of the State of Connecticut

(3) Please identify the names of all individuals and their professional, business or governmental affiliations who provided input to the DEIS and please identify the specific contribution of each.

(4) Please identify all consulting contracts entered into with consultants on the DEIS, provide a copy of such contracts and the cost of each such service.

(5) Please identify with specificity what "other available information" was considered which led the staff to conclude "that there are no impacts of radiation exposures to the public during the renewal term beyond those discussed in the GEIS" and "that there are no impacts of occupational radiation exposures during the renewal term beyond those discussed in the GEIS." (DEIS at 4.3) Please further identify all sources considered.

(6) Please identify all refurbishment identified by the licensee other than" major" refurbishment and identify the methodology used by the NRC staff to evaluate this issue and whether the licensee's characterization of refurbishment issues as not "major" was accurate. (DEIS Section 3.0)
