Supervisory Brief: Another Step Taken Toward Ucense Extension Another Step Taken Toward License Extension DATE: Friday, July 25, 2008 FROM: Tim Rausch, Site Vice President L INSTRUCTIONS: Please ensure that this message is communicated to all of your team members TeamOysterCreek took another step forward toward license extension on Thursday, when the Atomic Safety and Licensing Board issued a decision denying a citizens' motion to admit a contention concerning recirculation nozzle fatigue.

The majority of the ASLB ruled that the citizens' April 18 motion to reopen the record failed to raise a significant safety issue or demonstrate that a materially different result was likely. The ASLB also denied a later May 27 motion by citizens for similar reasons. The second motion challenged the information in AmerGen's response to the NRC request for additional information on the metal fatigue issue.

Though one member of the 3-judge panel issued a dissenting opinion in decision, this is a positive step forward for TeamOysterCreek. However, we do expect citizens to appeal this decision to the Commission delaying final resolution.
