x UNOPPOSED MOTION BY THE STATE OF NEW YORK TO FILE A COMBINED 10-PAGE REPLY BRIEF Office of the Attorney General for the State of New York The Capitol State Street Albany, New York 12224
The State of New York respectfully requests that the Commission (or the Secretary of the Commission acting pursuant to her authority under 10 C.F.R. § 2.346) grant the States unopposed request to submit a single combined 10-page reply to NRC Staff and Entergys separate answers filed on May 23, 2014 in response to the States April 28, 2014 petition for review. In accordance with 10 C.F.R. § 2.323(b), the State has consulted with Entergy and NRC Staff and neither opposes the States request.
10 C.F.R. § 2.341 authorizes a petitioner to submit a five page reply to each answer to a petition for review. In this case, § 2.341(b)(3) would authorize the State to submit two separate five page replies (collectively totaling 10 pages) in response to NRC Staff and Entergys answers. Given that the answers concern the same petition for review, the State submits that a combined reply to both Staffs and Entergys separate answers will promote efficiency, avoid duplicative responses to similar arguments raised by Entergy and Staff, and streamline filings.
Thus, there is good cause for the States request.
Also, the request will not delay the States reply. Under § 2.341(b)(3) the States reply papers may be filed within 10 days of service of any answer - or by Monday, June 2, 2014.
Accordingly, the State requests that the Secretary or the Commission grant the motion.
