WESTINGHOUSE ELECTRIC COMPANY LLC - APPROVAL OF ENVIRONMENTAL SAMPLING AND MONITORING PROGRAM

Dear Jeff Ferguson:

The U.S. Nuclear Regulatory Commission (NRC) reviewed the submission from Westinghouse Electric Company LLC (Westinghouse or WEC) requesting review and approval of the revised environmental sampling and monitoring program. The application was transmitted by letter dated April 24, 2023 (Agencywide Documents Access and Management System [ADAMS]

Accession Number ML23114A358). Westinghouse submitted its request pursuant to License Condition (LC) S-17 in the renewed license issued September 12, 2022 (ML22157A348).

The applicable LCs from SNM-1107(renewed 2022) are:

License Condition S-17: WEC shall submit its environmental sampling and monitoring program (Section 10.1.4 of the LRA) to the NRC for review and approval upon South Carolina Department of Health and Environmental Controls approval of the Remedial Investigation Report, or within five years of the license renewal (whichever comes first).

License Condition S-18: Within 90 days of submittal of the CA [Consent Agreement] final written report to SCDHEC, WEC shall submit its environmental sampling and monitoring program described in Section 10.1.4 of the LRA to the NRC for review and approval.

On March 23, 2023, the South Carolina Department of Health and Environmental Control (SC-DHEC) approved the Final Remedial Investigation Report (RI) for the Columbia Fuel Fabrication Facility (CFFF). Westinghouse provided a copy of the RI for the CFFF Site and the SC-DHEC approval letter in the request as supporting information. LC S-17 required the submission of the CFFF environmental sampling and monitoring program (Section 10.1.4 and associated tables and figures of the SNM-1107 License Application) once the RI was approved by SC-DHEC. No changes were made to the program as a result of the SC-DHEC review.

The NRC staff reviewed the April 24, 2023, submission and determined that the licensees revised monitoring and sampling program is acceptable and conforms to LC-17 because the program can properly delineate the plume boundaries of the contaminants of potential concerns.

Per LC S-18, the NRC staff will have another opportunity to review and approve the environmental sampling and monitoring program after Westinghouse submits the final written report under the Consent Agreement currently in place with SC-DHEC.

J. Ferguson 2 The NRC staff has completed its review of the April 24, 2023, request. This action closes activities under Enterprise Project Identifier L-2023-LLL-0010.
