Ken, By License Amendment Request dated April 29, 2016 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML16125A253), Florida Power & Light Company (the licensee) submitted a request to revise Appendix B (Environmental Protection Plan (EPP)) of the Unit 1 and Unit 2 Operating Licenses to incorporate the revised Section 8.4, Terms and Conditions of the currently applicable Biological Opinion issued by the National Marine Fisheries Service (NMFS) on March 24, 2016 and clarify in the EPP that the licensee must adhere to the currently applicable Biological Opinion.

The U.S. Nuclear Regulatory Commission Staff reviewed the submittal and identified areas where it needs additional information and clarification to complete its review. The Request for Additional Information (RAI) is provided below. The NRC requests that the licensee respond to this RAI within 45 days of this email.

REQUEST FOR ADDITIONAL INFORMATION ST. LUCIE, UNITS 1 AND 2 LICENSE AMENDMENT REQUEST FOR BIOLOGICAL OPINION LICENSE CHANGES DOCKET NOS. 50-335 AND 50-389 CACs MF7661 & MF7662 By letter dated April 29, 2016 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML16125A253), Florida Power & Light (the licensee) submitted a license amendment request (LAR) for NRC approval to update Appendix B (Environmental Protection Plan (EPP)) of the St. Lucie Plant Unit Nos. 1 and 2 (St. Lucie) operating licenses to reflect the currently applicable Biological Opinion issued by the National Marine Fisheries Service (NMFS) on March 24, 2016. In addition, the amendments would clarify in the EPP that the licensee must adhere to the currently applicable Biological Opinion. The staff review of the licensees 4/29/16 LAR has resulted in the following requests for additional information:

Background

As part of its National Environmental Policy Act (NEPA) review, the U.S. Nuclear Regulatory Commission (NRC) staff must evaluate both the direct and indirect impacts of the proposed amendments. One potential indirect impact of the proposed amendments is that FPL will design, test, construct, and implement turtle excluder devices for the St. Lucie intake pipe velocity caps in accordance with Term and Condition 1 of Reasonable and Prudent Measure 1 of the National Marine Fisheries Services (NMFS) March 24, 2016, biological opinion (ADAMS Accession No.

ML16084A616). Please answer the following regarding implementation of the excluder devices in order to assist the NRC staff in assessing the environmental impacts of the proposed amendments.

RAI-MF7661/2-RERP-01 Describe the potential non-radiological environmental impacts of testing, constructing, and implementing the excluder devices. Include such potential impacts as those to water resources during testing and constructing, such as any disruption or other impacts to aquatic biota and habitats due to possible sediment disturbance and turbidity, any disruption or other impacts to land or terrestrial biota and habitats, and the effects of air emissions from construction equipment.
