SOUTH TEXAS PROJECT, UNITS 1 AND 2 - RE: WITHDRAWAL OF LICENSE AMENDMENT REQUEST FOR DEVIATION FROM FIRE PROTECTION PROGRAM REQUIREMENTS (TAC NOS. MD8112 AND MD8113)
Dear Mr. Halpin:
In the application dated February 4, 2008 (NOC-AE-07002212), as supplemented by the letter dated April 24, 2008 (NOC-AE-08002295) (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML080390483 and ML081220708, respectively), South Texas Project Nuclear Operating Company (STPNOC) requested a license amendment to the fire protection program requirements for a deviation from the requirements in Appendix R to Part 50 of Title 10 of the Code of Federal Regulations (10 CFR Part 50, Appendix R). The supplemental letter dated April 24, 2008, provided a justification for withholding from the public sensitive unclassified non-safeguards information provided in Attachment 2 to the application. Currently, this information is declared in ADAMS as non-publicly available.
In the letter dated June 16, 2008 (NOC-AE-08002322, ADAMS Accession No. ML081820441),
STPNOC withdrew the license amendment request in its application dated February 4, 2008, and withdrew the commitments that it made in Attachment 3 to the application.
The purpose of this letter is to advise that the above-cited application is being treated as withdrawn and the subject TAC numbers shall be closed. A Notice of Consideration of Issuance of the proposed amendment had not been published in the Federal Register. Since the application is withdrawn, Attachment 2 to the application, which contains the information requested to be withheld from the public, will be deleted from ADAMS.
