UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION ATOMIC SAFETY AND LICENSING BOARD Before Administrative Judges:

Lawrence G. McDade, Chairman Dr. Michael F. Kennedy Dr. Richard E. Wardwell In the Matter of

ENTERGY NUCLEAR OPERATIONS, INC.

(Indian Point Nuclear Generating Units 2 and 3)

Docket Nos. 50-247-LR and 50-286-LR

ASLBP No. 07-858-03-LR-BD01 May 16, 2012 ORDER (Granting Unopposed Extension of Time)

Intervenors -- the State of New York, Riverkeeper, Inc., and Hudson River Sloop Clearwater -- and Interested Governmental Entities -- the State of Connecticut and the Town of Cortlandt, New York -- have filed an unopposed joint motion to alter the time within which they may file their responsive testimony and statements of position, from May 29, 2012, to June 29, 2012.1 The instant motion also requests that, should the extension relating to paragraph K.3 of the Board's July 1, 2010 Scheduling Order be granted, all subsequent related deadlines in paragraphs K and L of that Order be extended.

2 1 See Unopposed Joint Motion for an Extension of Time for Filing Intervenor Rebuttal Testimony, Interested Governmental Statements and Affiliated Subsequent Deadlines (May 15, 2012) at 1 [hereinafter Motion]. These evidentiary submissions are permitted pursuant to paragraph K.3 of the Board's July 1, 2010 Scheduling Order. See Licensing Board Scheduling Order (July 1, 2010) at 14-15 (unpublished).

2 See Motion at 1. For good cause shown, the Board hereby grants the motion. The extension to June 29, 2012, as well as the corresponding extension of subsequent deadlines, applies to all participants. This extension covers contentions whose evidentiary submissions would have been due on May 29, 2012. It is so ORDERED. FOR THE ATOMIC SAFETY AND LICENSING BOARD
