New and Significant Information Rochester Gas and Electric Corporation (RG&E) prepared the Ginna Station Environmental Report - Operating License Renewal Stage (ER) in accordance with the regulations at 10 CFR 51.53(c). The NRC regulation specifically states that applicants need not provide additional analysis for Category 1 issues [10CFR51.53(c)(3)(i)]; however, the NRC regulation requires that license renewal applicants submit in the ER "...any new and significant information regarding the environmental impacts of license renewal of which the applicant is aware..."
[10CFR51.53(c)(3)(iv)].
RG&E conducted an assessment for new and significant information as part of its preparation of the ER for the license renewal of Ginna Station. The process was directed by the License Renewal Project Environmental Review Lead and included the following actions: (1) interviews with RG&E subject experts on information related to the conclusions in the Generic EnvironmentalImpact Statementfor the License Renewal of NuclearPower Plants(NUREG 1437, GEIS) as they relate to Ginna Station, (2) review of RG&E's environmental management system and the plant's environmental management matrix for how current programs manage potential impacts and/or provide mechanisms for RG&E staff to become aware of new and significant information, (3) correspondence with state and federal regulatory agencies to determine if the agencies had concerns not addressed in the GEIS, (4) review of documents related to environmental issues at Ginna Station and regional environs.
As a result of this assessment and as stated in Chapter 5 of the ER, RG&E is aware of no new and significant information regarding the environmental impacts of Ginna Station license renewal and continued operation.

- 2. Information on Portof Rochester The Port of Rochester was decommissioned as a commercial port in 1980. It is now used by two cruise ships in the summer, each of which docks four times per summer to discharge and pickup passengers. In addition, a cement freighter passes by the Port of Rochester, but docks further south on the Genesee River at a cement plant on Boxart Street.
If the Fast Ferry project moves forward, the Port of Rochester will be designated a Class A Federal Port of Entry, which would allow commercial use. The very earliest this might occur is Fall 2003.

- 3. Wayne and Monroe County Land Use We do not have the information readily available. Rachel Bell from the Monroe County Planning Department said that they do produce a land use report on a yearly basis but it doesn't appear to have land use by acreage anywhere. The link is below.

- 1) Operating License Renewal for Nuclear Power Plants, U.S. Nuclear Regulatory Commission.
- 2) Per the Coastal Zone Management Act, a Federal Consistency Assessment Form has been submitted to NYSDOS. A draft copy of this Consistency Review is included within the License Renewal Application Environmental Report included with this Joint Application.
Additional Information In partial fulfillment of an application by RG&E for a new Section 401 Water Quality Certification (WQC) in conjunction with Ginna Station License Renewal, the NYSDEC requested a brief status report regarding the 1974 401 WQC as it relates to the current Ginna SPDES Permit and water quality standards, as well as new items of relevance brought into the Ginna SPDES Permits since its initial issuance 1 . Previously, the NYSDEC had submitted comments regarding environmental issues to be included within the Environmental Report submitted as part of the Ginna Station License Renewal Application 2. Therefore, in support of this 401 WQC Application RG&E hereby provides information which encompasses the three areas identified below.
- 1) A status report of the Section 401 WQC for the Ginna Nuclear Facility, dated April 26, 1974, with respect to its incorporation into the Ginna Station N/SPDES Permit(s).
- 2) Identification of new items of relevance incorporated into Ginna SPDES Permits since the original 401 WQC.
- 3) Identification of the environmental issues put forth by NYSDEC to date concerning the Ginna Station License Renewal Application Environmental Report.
- 1) 401 WQC Status Report The 401 WQC status report required a comprehensive review of historical Ginna Station 401 WQC and N/SPDES files. This review identified a lengthy period of negotiation among NYSDEC, USEPA and RG&E following the issuance of the 401 WQC in 1974, which culminated with the 1975 Ginna NPDES Permit being agreed upon by all parties in June 1978.
NYSDEC's acceptance of this Permit substantiates that all water quality concerns contained within the 401 WQC were satisfied. Specifically, the following list identifies the effluent limitations, other limitations and monitoring requirements which were contained within the 401 WQC for Ginna Station, and specifies how each condition was incorporated within subsequent Ginna Station N/SPDES Permit(s).

Attachment to Rochester Gas and Electric Corporation's Joint Application for Permit, Regarding Section 401 Water Quality Certification for Ginna Station License Renewal 0 401 WOC Condition 1: The Ginna intake system was to be modified in order that, or information submitted which demonstrated that, its operation would not result in unacceptable damage to aquatic biota.
N/SPDES Condition: This WQC Condition was incorporated into the 1975 Ginna NPDES Permit as Condition 10(b).
- 401 WQC Condition 2: Submittal of a report defining all water treatment, corrosion inhibitor, anti-fouling, slimicide, bio-cide and boiler cleaning chemicals or compounds.
Also, wastewaters containing chemicals and oils shall be collected and treated prior to dilution with non-contact cooling water.
N/SPDES Condition: Compliance with the first part of this WQC Condition, concerning identification of water treatment chemicals, was achieved by a submittal to NYSDEC on August 2, 1974. The second portion of this WQC Condition, concerning treatment of individual wastestreams, was incorporated within the SPDES Permit effective May 1985.
- 401 WOC Condition 3: Submittal of a report on chlorine use and chlorination practice, and a maximum discharge effluent concentration of 0.5 mg/l residual chlorine.
N/SPDES Condition: This WQC Condition was incorporated into the 1975 Ginna NPDES Permit as Conditions 9.b.(1)(d) and 1 1(c).
- 401 WQC Condition 4: Submittal of a report on fish impingement to that date.
N/SPDES Condition: This WQC Condition was incorporated into the 1975 Ginna NPDES Permit as Condition 11 (c).
- 401 WQC Condition 5: Submittal of a report on entraiment to that date.
N/SPDES Condition: This WQC Condition was incorporated into the 1975 Ginna NPDES Permit as Condition 11 (c).
- 401 WQC Condition 6: Submittal of a detailed biological program designed to determine the effects of facility operation on aquatic organisms.
N/SPDES Condition: This WQC Condition was incorporated into the 1975 Ginna NPDES Permit as Condition 11 (b), and includes the requirement for a Section 316(a) Demonstration Supplement.
- 401 WQC Condition 7: Submittal of monthly operating reports which include station electrical output, station water use, and intake and discharge temperatures.
N/SPDES Condition: This WQC Condition was incorporated into the 1975 Ginna NPDES Permit as Condition 1l(h)(2).

- 401 WOC Condition 9: Submittal of any applications, reports and supporting data pursuant to Sections 316(a) and (b).
N/SPDES Condition: This WQC Condition was incorporated into the 1975 Ginna NPDES Permit as Condition 11 (b).
- 401 WQC Condition 10: Any 401 WQC condition that requires construction in or on waters of the state or banks or bed thereof, requires approval under stream protection regulations.
N/SPDES Condition: This WQC Condition was incorporated into the 1975 Ginna NPDES Permit as Condition 7.
- 401 WQC Condition 11: No residue attributable to sewage, industrial wastes or other wastes nor visible film nor globules of grease.
N/SPDES Condition: This WQC Condition was incorporated into the 1975 Ginna NPDES Permit as Condition 10(a)(2).
- 401 WQC Condition 12: No taste and odor-producing substances, toxic wastes and deleterious substances in amounts that would be injurious to, or adversely affect the flavor, color or odor of fishlife.
N/SPDES Condition: This WQC Condition was incorporated into the 1975 Ginna NPDES Permit as Condition 10(a)(3).
- 401 WQC Condition 13: No thermal discharge which will be injurious to fishlife, or prevents the best usage determined for the water's class.
N/SPDES Condition: This WQC Condition was incorporated into the 1975 Ginna NPDES Permit as Condition 10(a)(1).
- 401 WQC Condition 14: No suspended, colloidal or settleable solids from sewage industrial wastes or other wastes which will cause deposition or be deleterious for any best usage determined for the water's class.
N/SPDES Condition: This WQC Condition was incorporated into the 1975 Ginna NPDES Permit as Condition 10(a)(4).
- 401 WOC Condition 15: Copies of any environmental related reports submitted to any Agency shall also be submitted to DEC.

- 401 WQC Condition 16: This condition refers to severability of the WQC from other legal issues between DEC and RG&E.
N/SPDES Condition: Not applicable to inclusion in an N/SPDES Permit.
The above review verifies that the 1974 401 WQC was fully incorporated into the Ginna Station N/SPDES Permits, and that RG&E is in compliance with all conditions of that 401 WQC. This includes the incorporation of water quality standards in existence at the time of issuance. As part of the NYS SPDES Permitting Program, water quality standards revised since the initial permit would have been incorporated into SPDES Permit renewals, as necessary.
- 2) New Items of Relevance Since the Original 401 WQC for Ginna Station
" The 1975 NPDES Permit was renewed as an SPDES Permit in 1985, expiring in 1990.
> This Permit reflected results of priority pollutant sampling required in the Permit Application.
> Monitoring and limiting requirements were required for all significant discharges (i.e.,
internal waste streams), increasing the number of discharge points from 2 (CHECK NO.) to 11, along with a corresponding increase in required monitoring, including Action Levels for a number of parameters.
> NYSDEC granted RG&E's request for a 316(a) thermal variance, with no further tri-axial studies required.
> NYSDEC tentatively determined to approve RG&E's request pursuant to 316(b),
concerning the intake system. Further biological monitoring with respect to impingement was required.
> In 1988 pH excursions within the 002-A discharge were addressed by RG&E through extensive modifications to the retention tank system.
> In August 1990, a permit modification was adopted regarding a zebra mussel control treatment program utilizing chlorine.
" The next Ginna SPDES Permit was effective 1992 to 1997.
> NYSDEC continued the 316(a) thermal variance.
> A High Conductivity Waste Tank discharge limit was included for iron which subsequently required RG&E to install an extensive filtration system.
> NYSDEC tentatively approved RG&E's request pursuant to 316(b), requiring continued impingement monitoring and the following two new requirements.
- 1. Investigate means to reduce water use during both normal operations and outages.
RG&E complied with this requirement in July 1998.
- 2. Modify and resurface screen washwater / fish and debris sluice to improve fish survival. RG&E complied with this requirement in July 1998.

" The Ginna SPDES Permit was renewed for the period July 1997 to July 2002 under the NYSDEC Environmental Benefit Permit Strategy.
> The Permit was modified for addition of Discharge Notification Act Requirements.
Compliance October 1997.
" Based upon RG&E's request for permit modifications, the Permit was modified and re issued in February 1998, effective to February 2003.
> No changes were made to the 316 (a) or (b) approvals, or biological monitoring program.
> Much of the increased monitoring incorporated in the 1985 permit was reduced or eliminated due to results documented over the previous 12 years.
> A stormwater pollution prevention plan was required by this permit. RG&E complied with this requirement in July 1998.
- 3) NYSDEC License Renewal Environmental Issues NYSDEC has previously provided RG&E with comments regarding environmental issues to be included within the Environmental Report submitted as part of the Ginna Station License Renewal Application2 , and RG&E has subsequently responded to these comments 3. Following is a summary of the NYSDEC comments and RG&E's responses.
- Entrainment NYSDEC suggests that an entrainment study be conducted at Ginna, and has recently included a condition for such monitoring within a draft modification of the Ginna SPDES Permit. Overall, RG&E acknowledges the value of conducting an in-plant entrainment study to update and expand the existing database, and looks forward to developing a mutually acceptable program with NYSDEC.
- Impingement NYSDEC recommends that the Ginna Station impingement reports be used to summarize the facility's potential impacts upon the Lake Ontario fisheries within the Environmental Report, and that gobies and yellow perch be included as target species within the impingement program.
RG&E agrees, and has already complied, with both of these recommendations.
The NYSDEC also reviewed RG&E's modifications to the travelling water screens, which are currently underway, and concluded that they will meet Best Available Technology standards.
- Heat Shock NYSDEC has approved RGE's request for alternative effluent limitations pursuant to Section 316(a) of the Clean Water Act and 6 NYCRR Part 704 for the 5 year life of the permit.

Attachment to Rochester Gas and Electric Corporation's Joint Application for Permit, Regarding Section 401 Water Quality Certification for Ginna Station License Renewal NYSDEC has also requested that RG&E evaluate the issue of exposing impinged fish to elevated temperatures as they return to the lake via the discharge canal. This evaluation was performed and included within RGE's Ginna License Renewal Environmental Report, Section 4.3.
9 Threatened and Endangered Species NYSDEC determined that no threatened, endangered, rare, or protected species are known to exist in the project area. Also, since no new construction is proposed, NYSDEC does not recommend any field confirmation of the federal and state databases.

"* Historical and archeological resources Since no new construction is proposed, NYSDEC does not recommend any literature or field studies concerning historical or archeological resources.
- Severe Accidents The NYSDEC provided lengthy comments concerning this topic, however, RG&E believes that such comments relate to the technical portion of the License Renewal Application, and appear to be a repetition of responses RG&E provided to earlier NYSDEC questions put forth during previous presentation meetings between NYSDEC and RG&E. RG&E further believes that these items are not within the scope of the 401 WQC, and will therefore be addressed in another aspect of the application
- Environmental Justice NYSDEC will provide comments, if necessary, on this issue after the Department has adopted a final Environmental Justice Policy.
- 6 NYCRR Part 373 Hazardous Waste Facility Permit NYSDEC and RG&E concur with the continuation of Interim Status for the Ginna Station 373 Permit and associated annual inspections, pending final determination by NYS concerning adoption of a USEPA exemption for facilities in compliance with 40 CFR Part 266.
- State Pollution Discharge Elimination System (SPDES) Permit Compliance A SPDES inspection conducted by NYSDEC Region 8 on March 22, 2002 found Ginna Station to be in compliance with the facility's SPDES Permit. Further, NYSDEC is currently processing PMS842.doc Page 6 of 7 10/04/2002

- Shoreline Protection NYSDEC requested that RG&E provide an evaluation of coastal erosion on-site and on neighboring properties. This evaluation was performed and included in the Ginna License Renewal Environmental Report, Section 2.2.

8.0 PREREQUISITES Previous years Land Use Census mapand data.
9.0 INSTRUCTIONS Note: Use of Global Positioning System (GPS) may assist in determining position and distance from the plant site.
9.1 Travel along each of the roads surrounding the Ginna Plant and determine if ihe use of the land has changed from that previously established.
9.2 Record changes on the attached maps and list on Table I. F-Note: In lieu of a garden census, an onsite garden located in the meteorological sector having the highest historical D/Q or in a location with a higher D/Q than the maximally exposed individual may be used for broad leaf vegetation sampling.
9.3 Check for home gardens within 5 miles and estimate if their area exceeds 500 sq. ft.

9.4 Record on Attachment I the location of the nearest garden exceeding 500 sq. ft. in each sector.
9.5 Identify the location of the nearest residence within 5 miles in each sector and list on Table I.
9.6 Identify all locations of milk producing animals within five (5) miles of the plant for each sector and list on Table I.
Note: Only those houses associated with barns are likely to have milk animals. It may be necessary to inquire at each house if it is not readily discernable whether milk animals are kept.
Talking to the County Agent may determine locations of cows and goats used for milk production. Goats are of concern when their milk is used for children.
9.7 Update Attachment I and the attached maps as necessary.
9.8 Report any new location identified which yields a calculated dose or dose commitment greater than that of the maximally exposed individual currently used in the Annual Radioactive Effluent Release Report.
9.9 Include Attachment I with updated maps in the Annual Radiological Environmental Operating Report.
9.10 Evaluate industrial or land use change for affect on information contained within the UFSAR.

Dear Commissioner Castro,
Rochester Gas and Electric (RG&E) is preparing an application to renew the operating license for the Ginna Nuclear Power Plant for a period of twenty years, thereby extending operation into the year 2029. We intend that the application be consistent with your Agency's interests and the priorities of our community. The attached information includes an overview of the facility, the license renewal process, and license renewal Environmental Report (ER) activities. Please be advised that this license extension would result in no new operational or refurbishment activities for the period of the proposed extended operations, and there would be no increase in generation nor any change in any physical process associated with the generating plant. In summary, operations throughout the license renewal period would essentially be a continuation of current operational practices and procedures.
The National Historic Preservation Act requires the Nuclear Regulatory Commission (NRC) to consult with the State Historic Preservation Officer (SHPO) to determine whether there are properties present that require protection. These findings will be used by NRC in their preparation of an environmental impact statement to support the license renewal process. It is our intent to contact your Office early in the process in order to identify and address any concerns, so that the NRC consultation proceeds smoothly and efficiently. Please be advised that RG&E has previously contacted SHPO regarding this project, and has received a response dated October 31, 2001 (copy attached). Although RG&E has already been in communication with SHPO, we believe it is appropriate to send your Office the enclosed supporting materials concerning the Ginna Plant License Renewal Project for your information.
