Attached is the Office of the Inspector Generals (OIG) analysis and status of recommendation as discussed in the agencys response dated December 28, 2023.
Based on this response, recommendations 1.1 through 2.1 are closed. Recommendation 3.1 remains open and resolved. Please provide an updated status of the open, resolved recommendation by December 30, 2024.

Recommendation 1.1: Update agency policies to require that staff provide complete information on screening evaluation forms, correctly profile evaluation forms in the Agencywide Documents Access and Management System (ADAMS), and publicly share non-sensitive reactive inspection screening decision-making, whenever possible.
 
Agency Response Dated December 28, 2023: On December 14, 2023, the Office of Nuclear Reactor Regulation (NRR) issued a revision to Inspection Manual Chapter (IMC) 0309, Reactive Inspection Decision Basis for Reactors (ML23341A159). This revision directed staff to:
(1) provide sufficient information for each criterion response; (2) profile the determinations in ADAMS using the revised NRR-123 template; and (3) publicly released non-sensitive information screening forms either after any follow-up inspection (baseline or reactive) is completed and the associated inspection report is issued or when a decision is taken during the reactive inspection screening process that no further inspection was warranted.
 
Further, the IMC 0309 revision directs staff to profile decision documentation enclosures in accordance with Management Directive 3.4, Release of Information to the Public.
 
The NRR staff also verified that all completed evaluation forms identified in OIG-23-A-06 have been correctly profiled.
 
OIG Analysis: The OIG reviewed and verified: (1) revisions to IMC 0309 directing staff to provide sufficient information

Recommendation 1.1 (continued):
 
for each criterion response; (2) clarify the profiling process in ADAMS; (3) directing staff to publicly release non-sensitive information screening forms either after an initial baseline inspection is completed and the associated inspection report is issued or when a decision is taken that no further inspection is warranted during the reactive inspection screening process; and (4) directing staff to profile decision documentation enclosures in accordance with Management Directive 3.4, Release of Information to the Public.
 
The OIG reviewed and verified the re-profiling of completed evaluation forms identified in the audit (OIG-23-A-06) as now correctly profiled in ADAMS.
 
This recommendation is now closed.

Recommendation 2.1: Update agency policies so that they provide a well-defined incident screening process with examples for screening reactor safety and security events.
 
Agency Response Dated December 28, 2023: In addition to th e changes noted in the status update to Recommendation 1.1, the IMC 0309 revision includes criteria screening examples to assist staff in completing decision documentation enclosures.
 
OIG Analysis: The OIG reviewed and verified that the IMC 0309 revision provided a clearly defined incident screening process with examples for screening reactor safety and security events.
This recommendation is now closed.

4 Audit Report AUDIT OF THE U.S. NUCLEAR REGULATORY COMMISSIONS PROCESSES FOR DEPLOYING REACTIVE INSPECTION TEAMS Status of Recommendations (OIG-23-A-06)
 
Recommendation 3.1: Periodically assess the effectiveness of MD 8.3, NRC Incident Investigation Program, and IMC 0309 implementation.
 
Agency Response Date December 28,2023: The staff continues to develop and document its procedures for conducting periodic effectiveness reviews of:
(1) Management Directive 8.3, NRC Incident Investigation Program; and (2) the implementation of IMC 0309. The procedures are on target to be completed by November 2024.
 
OIG Analysis: The proposed actions meet the intent of this recommendation. The OIG will close this recommendation upon reviewing the enhancements to the process to periodically review MD 8.3 and IMC 0309. This recommendation remains open and resolved.
 
Status: Open: Resolved.
