December 27, 2010 ORDER (Granting Intervenor's Unopposed Joint Motion for an Extension of Time)
On December 23, 2010, the State of New York, the State of Connecticut, Riverkeeper, Inc., and Hudson River Sloop Clearwater moved to ex tend the time within which they could file motions for summary disposition and/or file new or amended contentions arising from the publication by the NRC Staff on December 3, 2010, of the Final Supplemental Environmental Impact Statement (FSEIS) for the requested renewal of the Indian Point operating licenses. Without an extension, based on the Scheduling Order that this Board entered on July 1, 2010, such motions would be due no later than January 3, 2011. We have been advised that neither the applicant, Entergy Nuclear Operations, Inc., nor the NRC Staff opposes any aspect of the motion for an extension of time.
Good cause having been shown, the Board grants the unopposed motion. Motions for summary disposition and motions to file new or amended contentions that are properly based on significantly new data or conclusions in the FSEIS will be considered timely if filed on or
before February 3, 2011.
It is so ORDERED.
