I am writing on behalf of residents of my district who live within or adjacent to the Emergency Planning Zone of the Seabrook, New Hampshire nuclear power plant.
I am writing on behalf of residents of my district who live within or adjacent to the Emergency Planning Zone of the Seabrook, New Hampshire nuclear power plant. I am writing to request that a thorough investigation be made into the quality of construction at Seabrook Station.

This request is made in light of two extremely disturbing circumstances revealed within the past two weeks concerning safety conditions at Seabrook.

On Tuesday, June 4, 1985, a former Seabrook Station employee, a quality control technician, was indicted by a Federal Grand Jury on eleven counts of submitting false information to a Federal agency.

I fear that this may only be the tip of the iceberg of questionable workmanship at this nuclear facility. I am also concerned that a prolonged court case could prevent further information from coming forward until after the plant is licensed for operation. Rumors and claims of construction irregularities at the plant have been reported by workers at the plant since its beginnings a decade ago. Residents and visitors to the seacoast area must be assured that this plant has been constructed under maximum quality control procedures.

)                   Waukesha, Wisconsin, for submitting falsified reports in a matter within the jurisdiction of the Nuclear Regulatory Commission, an agency of the United States Government.             Padavano had been employed by the Pullman Higgins Company as a non-destructive examination technician at the Seabrook Nuclear Power Station between December 1982 and April 1983. Pullman Higgins Company runs the quality assurance program at the plant and performs safety and non-safety related testing of welds on the various piping systems within the plant.       Reports of the tests performed on these welds are required to be maintained by the Nuclear Regulatory Commission.       It is alleged in the indictment that Padavano f ailed to complete a number of " Liquid Penetrant Examinations" of the welds he was assigned to test and thereafter falsified reports indicating he had completed the examinations.

Figure 10 of the July version has a totat Summer Weekend Transient Population of 143,056, Uhereas the March 1984 varsion has the same population figure shouing a total of 176,905 people. Yet the summary of resulte (Table 16 on page V-6) of each report ars absolutely identical, as are the computer printout cectione of both r3porte. Thie le not poselbte. Additionally, the July study accumes (on page III-11) " beach visitore averaging 3.3 persone per vehicle" uilt ba teaving the area, whereas the March Study (page III-11) assumes that "bsach visitore averaging 5.5 persone per vehicle" vill be leaving the ar3a. -The cource of information cited for both reporte is identical.

Dear Chairman Palladino:

I am writing on behalf of residents of my district who live within or adjacent to the Emergency Planning Zone of the Seabrook, New Hampshire nuclear power plant.

I am writing to request that a thorough investigation be made into the quality of construction at Seabrook Station.

This request is made in light of two extremely disturbing circumstances revealed within the past two weeks concerning safety conditions at Seabrook.

On Tuesday, June 4, 1985, a former Seabrook Station employee, a quality control technician, was indicted by a Federal Grand Jury on eleven counts of submitting false information to a Federal agency.

The charges involve inspection reports of approximately 2400 welds.

I fear that this may only be the tip of the iceberg of questionable workmanship at this nuclear facility.

I am also concerned that a prolonged court case could prevent further information from coming forward until after the plant is licensed for operation.

Rumors and claims of construction irregularities at the plant have been reported by workers at the plant since its beginnings a decade ago.

Residents and visitors to the seacoast area must be assured that this plant has been constructed under maximum quality control procedures.

Second, I am equally concerned about discrepancies uncovered in the Seabrook Station Emergency Planning Zone Evacuation Time Study which have serious implications on the ability of authorities to safely evacuate the' area.

I have enclosed a correspondence from the Amesbury Radiological Response Plan Advisory Committee in this regard.

l Misrepresentations of fact and information found in the Time Study are as threatening to the public safety and welfare as are false statements of inspection reports.

Together, these issues raise very real questions for the residents of the Seabrook area.

James Vincent Padavano United States Attorney Bruce E. Kenna announced today that a federal grand jury has returned an eleven (11) count indictment against James Vincent Padavano, age 31,. of 525 Longbeard,

Waukesha, Wisconsin, for submitting falsified reports in a matter within the jurisdiction of the Nuclear Regulatory Commission, an agency of the United States Government.

Padavano had been employed by the Pullman Higgins Company as a non-destructive examination technician at the Seabrook Nuclear Power Station between December 1982 and April 1983.

Pullman Higgins Company runs the quality assurance program at the plant and performs safety and non-safety related testing of welds on the various piping systems within the plant.

Reports of the tests performed on these welds are required to be maintained by the Nuclear Regulatory Commission.

It is alleged in the indictment that Padavano f ailed to complete a number of " Liquid Penetrant Examinations" of the welds he was assigned to test and thereafter falsified reports indicating he had completed the examinations.

In April 1983, the Company performed a review and analysis of all of the " Liquid Penetrant" and " Magnetic Particle", testing conducted by Padavano during his employment.

The results of this review were in turn reported to the Nuclear P.egulatory Commission and evaluated by them.

The Nuclear Regulatory Commission has closed its investigation of the matter.

The criminal investigation of this matter was conducted by the Federal Bureau of Investigation upon referral from the Office of Investigations l

of the NRC.

j Padavano, if convicted, faces a maximum sentence of 55 years imprisonment and a $110,000 fine.

May 21, 1985 D3ar Senator Costello, The Amesbury Radiological Response Plan Advisory Committee, in the procese of studying the Cootetto, Lomaeney and DeNapoli Evacuation Cicar Time Estimates for the Seabrook Power Station, March 1984 and July 1983 has uncovered some disconcerting facto crucially affecting thn validity of that etudy. Figure 10 of the July version has a totat Summer Weekend Transient Population of 143,056, Uhereas the March 1984 varsion has the same population figure shouing a total of 176,905 people. Yet the summary of resulte (Table 16 on page V-6) of each report ars absolutely identical, as are the computer printout cectione of both r3porte. Thie le not poselbte. Additionally, the July study accumes (on page III-11) " beach visitore averaging 3.3 persone per vehicle" uilt ba teaving the area, whereas the March Study (page III-11) assumes that "bsach visitore averaging 5.5 persone per vehicle" vill be leaving the ar3a. -The cource of information cited for both reporte is identical.

different information. There are many other subtle changes between the tuo etudies, which would indicate that there uae at teach some attempt to lessen the strength of various traffic regulation requiremente.

. We are requesting that there be an investigation into the apparent discrepancy in the reeutta of these two studies. The March 1984 vareton is the one quoted by Civil Defense, and has been submitted to the NRC. If there has been any fatee information filed with that agency, it is a crime. As you vett knou, an accurate evacuation clear time study la abe~olutely essential to planning any radiological emergency evacuation.

We inelet that the State of Massachusette perform an impartial study, and are otrongly supporting the current state legislative initiative for an independent commiecion to undertake auch a study. The Costetto, Lomaaney and DeNapoli study has toet all credibility as an impartial guide to emergency planning, and auch a guide is essential to our mia:Lon.

The general consensas of these sources was that any increase in the number of overhight accommodations, campgrounds, seasonal dwellings, or 7

use of the beach f acilities, between 1985 and 2030 would be very modest.

This is due'primarily to the existing highly-saturated state of the summer

tourism and vacation trade in the study area, along with beaches presently being utilised at near capacity.1 Minter-transient growth was also

believed to be low during the planning period.

To account for any ex.;.ansion by existing facilities and/or constructidn of new facilities that might occur during the planning period, a projection rate i

of 14 growth per year for the first 5 years, 0.54-growth per year for the next 15 years, and 0.25%

i growth per year for the final 30 years was used.

Different criteria were applied to the model l

Dear Senator Costello:

It is unfortunate that you did not ask us about the concerns expressed in your letter to the chairman of the PRC and the Governor of Massachusetts.

If you had done so, you m uld have received a prompt, factual reply which might have addressed your concerns.

While you are probably already aware of the following facts, they are worth repeating here.

With respect to the indictment of Mr. James Padavano, a former welding inspector employed by a sub-contractor at the site, you should be aware that the federal charges of falsifying weld examination reports were the direct result of Seabrook's quality assurance program.

In April, 1983, the quality assurance program in place at Seabrook detected inconsistencies in reports flied by Mr.

Padavano.

Seabrook Station management immediately notified the United States Nuclear Regulatory Comission. Separate investigations by the IRC and Seabrook Station management confirmed our initial suspicions that this individual had been filing false reports. 'Ihe investigation also verified that the situation was isolated to one individual. He was terminated imediately.

We began an exhaustive re-examination of the wrk with which this inspector had been associated, some 2,400 items, to assure that Mr. Padavano's actions would not cmpromise the safe and reliable operation of the Seabrook Station. As a result of that program, any and all deficiencies which might have affected plant safety have been resolved.

In addition to the actions and re-examinations taken by the Seabrook Station management,the tRC performed an independent examination which resulted in a confirmatory statement that all areas inspected met licensing com-mitments and regulatory requirements.

However, falsifying this type of record is a federal offense.

Scabrook project personnel cooperated fully with the investigations both of the tRC Office of Investigations and the subsequent criminal investigation carried out by the Federal Bureau of Investigation.

In addition, Seabrook's coun-sel responsible for NRC matters worked closely with the United States Attorney's office to arrange for expeditious production of all requested project documents for use in the Grand Jury proceedings which resulted in the indictment.

'1he facts in this case are indisputable. 'Ihis problem was brought to light solely as a result of the thoroughness of the project's quality assurance program.

l se Page 2 Your letter also cited, as support for the claim, a time study done for a se nt of Seabrook's Emergency Planning Zone and referenced in a letter of inqu from the Radiological Response Plan Advisory Committee in Amesbug' dis-to the Federal Emergency Management Agency. Your letter refers to possible crepancies" in the study. A response to that Committee's concerns is being prepared and we will be happy to see to it that a copy of this response is forwarded to your office.

f At the risk of oversimplification, suffice it to say that information received from local officials who reviewed the 1983 draft indicated that the sunner transient populations assuned m that draft for certain areas may have been low. Further investigation identified a higher " persons per vehicle"~

number for the portion of the population that was at the beaches. As a result, the population estimate was revised upward.

This had no inipact upon the sumner evacuation time estimates because these are dependent upon the runber of vehicles and their movement in the area for which a finite number exists based upon the conservative assumption that the number is at a capacity peak. Capacity peak assunes a vehicle in every i

available parking space plus an allowance for illegally parked vehicles.
