Dear Chairman Barrett:

The U.S. Nuclear Regulatory Commission (NRC) is conducting an environmental review for a construction permit submitted by SHINE Medical Technologies, Inc. (SHINE), for a proposed radiOisotope production facility. The application was submitted by SHINE in a letter dated March 26, 2013, pursuant to Title 10 of the Code of Federal Regulations Part 50 (10 CFR Part

50) This facility, if licensed, would produce radioisotopes for use in diagnostic medical isotope procedures. The proposed location of this facility is approximately 4 miles south of Janesvilie, Rock County, Wisconsin.

As part of the NRC staff's review, a site-specific environmental impact statement (EIS) will be prepared under 10 CFR Part 51, the NRC's regulation that implements the National Environment Policy Act of 1969, as amended (NEPA). The EIS will include an analysis of environmental issues and will include analyses of potential impacts to historic and archaeological resources, terrestrial ecology, aquatic ecology, hydrology, and socioeconomic issues (among others) and will contain a recommendation regarding the environmental acceptability of the proposed action. Alternatives to the proposed action, including alternative sites, will also be considered.

As your Tribe has historic ties to southern Wisconsin, the NRC invites you to provide input to the scoping process relating to the NRC staff's environmental review of the application. In addition, as outlined in 36 CFR 800.8(c), the NRC plans to coordinate compliance with Section 106 of the National Historic Preservation Act through the requirements of the NEPA. The NRC wishes to ensure that you are afforded the opportunity to identify any concerns, provide advice on the identification of histonc properties, including those of traditional religious and cultural importance, and if necessary. partiCipate in the resolution of any adverse effects to such properties.

This facility, if licensed, would produce radioisotopes for use in diagnostic medical isotope procedures. The proposed location of this facility is approximately 4 miles south of Janesville, Rock County, Wisconsin.

As part of the NRC staff's review, a site-specific environmental impact statement (EIS) will be prepared under 10 CFR Part 51, the NRC's regulation that implements the National Environment Policy Act of 1969, as amended (NEPA). The EIS wilt include an analysis of environmental issues and will include analyses of potential impacts to historic and archaeological resources, terrestrial ecology, aquatic ecology, hydrology, and socioeconomic issues (among others) and will contain a recommendation regarding the environmental acceptability of the proposed action. Alternatives to the proposed action, including alternative sites, will also be considered.

As your Tribe has historic ties to southern Wisconsin, the NRC invites you to provide input to the scoping process relating to the NRC staff's environmental review of the application. In addition, as outlined in 36 CFR 800.8(c), the NRC plans to coordinate compliance with Section 106 of the National Historic Preservation Act through the requirements of the NEPA. The NRC wishes to ensure that you are afforded the opportunity to identify any concerns, provide advice on the identification of historic properties, including those of traditional religious and cultural importance, and If necessary, participate in the resolution of any adverse effects to such properties.
