PROPRIETARY DETERMINATION OF ELECTRIC POWER RESEARCH INSTITUTE TOPICAL REPORTS SUBMITTED VIA OCTOBER 5, 2017, LETTER

Dear Mr. Burgos:

By letter dated October 5, 2017 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML17289A507), the Electric Power Research Institute (EPRI) submitted letters and affidavits by Steven Swilley, Senior Director and Deputy Chief Nuclear Officer. The letters and affidavits requested that the information contained in the following EPRI reports be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations, Part 2, Section 2.390 (10 CFR 2.930).

1. Materials Reliability Program: Inspection Standard for Reactor Internals (MRP-228-Rev. 2). EPRI, Palo Alto, CA: 2015. 3002005386;
2. Materials Reliability Program: Screening, Categorization, and Ranking of B&W

[Babcock and Wilcox] Designed PWR [Pressurized Water Reactor] Internals Component Items (MRP-189-Rev. 2). EPRI, Palo Alto, CA: 2014. 3002004283;

3. Materials Reliability Program: Aging Management Strategies for B&W PWR Internals (MRP-231-Rev.3). EPRI, Palo Alto, CA: 2014. 3002004284;

5. Materials Reliability Program: Irradiated Materials Welding Guideline (MRP-379). EPRI, Palo Alto, CA: 2014. 3002002954;
6. Materials Reliability Program: Screening, Categorization, and Ranking of Reactor Internals Components for Westinghouse and Combustion Engineering PWR Design (MRP-191, Revision 1). EPRI, Palo Alto, CA: 2016. 3002007960;
7. Materials Reliability Program: Functionality Analysis for Westinghouse and Combustion Engineering Representative PWR Internals (MRP-230, Revision 2-Supplement 1). EPRI, Palo Alto, CA: 2016. 3002007955.

Nonproprietary versions of the documents were also provided and added to the NRC Library in ADAMS at Package Accession No. ML17289A507.

The detailed reasons for withholding the information was documented in the affidavits.

B. Burgos The NRC staff has reviewed your application and the statements in the affidavits, as well as the material, in accordance with the requirements of 10 CFR 2.390. Based on this review, the NRC staff has determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

Therefore, submitted information marked as proprietary will be withheld from public disclosure under 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, the agency may send copies of this information to its consultants working in this area. The NRC staff will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC staff.

You also should understand that the NRC staff may have cause to review this determination in the future (for example, if the scope of a Freedom of Information Act request includes your information). In all review situations, if the NRC staff makes a determination adverse to the above, you will be notified in advance of any public disclosure.

If you have any questions regarding this matter, I can be reached at 301-415-7297 or via electronic mail at Joseph.Holonich@nrc.gov.

Sincerely,

/RA/
