ALL AGREEMENT STATES, CONNECTICUT, INDIANA FEDERALLY RECOGNIZED TRIBES ISSUANCE OF NUREG-1757, VOLUME 2, REVISION 2, CONSOLIDATED DECOMMISSIONING GUIDANCE, CHARACTERIZATION, SURVEY AND DETERMINATION OF RADIOLOGICAL CRITERIA (STC-22-054)

Purpose:

To inform the Agreement States of the issuance of the subject document by the Office of Nuclear Material Safety and Safeguards (NMSS).

Background:

The U.S. Nuclear Regulatory Commission (NRC) is issuing NUREG-1757, Volume 2, Revision 2, Consolidated Decommissioning Guidance, Characterization, Survey, and Determination of Radiological Criteria. NUREG-1757 has been revised to address lessons learned and experience gained from review of license termination plans, decommissioning plans, and final status surveys for licensees undergoing license termination since the last revision to the document in September 2006. NUREG-1757, Volume 2, Revision 2, is applicable to all licensees that are subject to the license termination rule found in 10 CFR Part 20, Subpart E. NUREG-1757 is intended for use by applicants, licensees, NRC license reviewers, and other NRC personnel. It is also available to Agreement States and the public.

Discussion: NUREG-1757, Volume 2, Revision 2 Consolidated Decommissioning Guidance, Characterization, Survey, and Determination of Radiological Criteria (ML22194A859) was revised to address lessons learned and experience gained from review of license termination plans, decommissioning plans, and final status surveys for licensees undergoing license termination. The NUREG was updated to include new guidance related to dose modeling, as low as reasonably achievable criteria, surface water and groundwater characterization, use of engineered barriers, and radiological surveys (e.g., composite sampling, subsurface surveys, and surveys demonstrating indistinguishability from background).

Prior to issuance of NUREG-1757, Volume 2, Revision 2, for public comment, NRC issued the document to all Agreement States for review on July 26, 2020 (RCPD-20-004). Draft NUREG-1757, Volume 2, Revision 2 Consolidated Decommissioning Guidance, Characterization, Survey, and Determination of Radiological Criteria was published in the Federal Register (85 FR 79044) on December 8, 2020, with a 60-day public comment period. On January 22, 2021, (86 FR 6683) the NRC decided to extend the comment period until April 8, 2021. Over 200 comments were received on the draft document and the NRC staff's evaluation and resolution of the public comments are documented in ADAMS under ML21299A032. NRC staff addressed the public comments in the final version of the document. The final document was published in the Federal Register (87 FR 43906).

The Standing Committee on Compatibility reviewed the guidance and determined that NUREG-1757 is a matter of compatibility with the Agreement States and is designated as September 1, 2022

Compatibility Category C. This guidance should be implemented by the Agreement States within 6 months of issuance, i.e., March 2, 2023. However, the Committee noted that since some Agreement States do not allow for license termination under restricted conditions as stated in 10 CFR 20.1403, certain parts of this NUREG may not apply.
