Relief Request 08 and 09 For Fourth Ten-Year Inservice Inspection Interval, July 1, 2009

Dear Sir or Madam:

Entergy Nuclear Operations, Inc. (Entergy) submitted Relief Request No. 08 (RR-08) for the Indian Point Unit No. 2 (IP2) Fourth 10-year Inservice Inspection (ISI) Interval in Reference 1.

Reference 1 noted that the demonstration of a volumetric leak path assessment was an industry effort to meet changes to 10 CFR 50.55a and that the effort was still uncertain as to schedule.

Accordingly, RR-08 asked for an alternative to use a demonstrated leak path assessment as compliance with Code Case N-729-1. Reference 1 also noted that the early submittal was to allow the NRC ample time to review the relief request and, if the industry effort was successful, the relief request could be withdrawn. This letter withdraws RR-08 following the successful demonstration of a volumetric leak path.
