CONCLUSION OF SECTION 106 CONSULTATION AND NOTICE OF AVAILABILITY OF THE FINAL GENERIC ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWAL OF NUCLEAR PLANTS, SUPPLEMENT 23, SECOND RENEWAL, REGARDING SUBSEQUENT LICENSE RENEWAL FOR POINT BEACH NUCLEAR PLANT, UNITS 1 AND 2, FINAL REPORT (DOCKET NUMBERS: 50-266 AND 50-301)
Dear Daina Penkiunas:
The U.S. Nuclear Regulatory Commission (NRC) staff is conducting a review of the environmental effects of the proposed subsequent renewal of the renewed operating licenses for Point Beach Nuclear Plant, Units 1 and 2 (Point Beach) for an additional 20 years. Point Beach is operated by NextEra Energy Point Beach, LLC (NextEra) and is located in Manitowoc County, Wisconsin. NextEra submitted an application for Point Beach subsequent license renewal (SLR) by letter dated November 16, 2020, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants. The application is available through the NRCs Agencywide Documents Access and Management System (ADAMS), which is accessible online at https://www.nrc.gov/reading-rm/adams.html under Package Accession No. ML20329A292.
The purpose of this letter is to inform you of the notice of the public availability of the final report for the Point Beach SLR application supplemental environmental impact statement (SEIS)
(ML25191A238) and to document the NRCs conclusion of the National Historic Preservation Act of 1966, as amended (NHPA), Section 106 consultation consistent with Title 36 of the Code of Federal Regulations (CFR) Part 800.
On November 9, 2021, a notice was published in the Federal Register (FR) (86 FR 62220) stating that the NRC staff had issued its draft SEIS documenting its analysis and conclusions.
On August 6, 2024, the NRC published a final rule (89 FR 64166) revising its environmental protection regulations in 10 CFR Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions. The final rule updated the potential environmental impacts associated with the renewal of an operating license for a nuclear power plant for up to an additional 20 years, which could either be an initial license renewal or one term of SLR.
Revision 2 of NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants (ML24087A133), provides the technical basis for the final rule. The final rule became effective on September 5, 2024. Thereafter, consistent with its regulations and Commission direction, the staff prepared a second draft SEIS for the Point Beach SLR application to address new information obtained since the 2021 draft SEIS was published.

On April 16, 2025, and April 14, 2025, the NRC notified the Advisory Council on Historic Preservation (ACHP) and Wisconsin State Historic Preservation Officer (WI SHPO), and twenty-two Tribes, respectively, that the second draft SEIS was published and available for public comment, which included the NRC staffs finding of no adverse effect to historic properties and that the NRC would be using 36 CFR 800.8(c) to comply with NHPA Section 106 through the National Environmental Policy Act of 1969, as amended, process. Responses were received from the ACHP (no comments), two Tribes (one whose response indicated that the project is located outside their area of interest and the other having no comments), and WI SHPO. The response from WI SHPO, dated May 28, 2025, concurred with the NRCs determination of no adverse effect to historic properties. All information on NHPA Section 106 consultation is detailed in the final SEIS in Section 3.9 and Appendix C.
