NOTICE OF AVAILABILITY FOR PUBLIC COMMENT OF THE DRAFT SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT FOR THE CLINTON POWER STATION, UNIT 1 LICENSE RENEWAL APPLICATION (DOCKET NUMBER: 50-461)
Dear Chairman Darwin Kaskaske:
The U.S. Nuclear Regulatory Commission (NRC) staff is conducting a review of the environmental effects of the proposed renewal of the operating license for Clinton Power Station, Unit 1 (CPS) for an additional 20 years. CPS is operated by Constellation Energy Generation, LLC (CEG), and is located in Clinton, Illinois. CEG submitted an application for the license renewal in a letter dated February 14, 2024, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants. The application is available through the NRCs Agencywide Documents Access and Management System (ADAMS), which is accessible online at https://www.nrc.gov/reading-rm/adams.html under Package Accession No. ML24045A023. The purpose of this letter is to invite you to review and comment on the staffs draft plant-specific supplemental environmental impact statement (SEIS).
For reference, the Atomic Energy Act of 1954, as amended, authorizes the NRC to issue 40-year initial licenses, and upon application and approval, renew licenses for nuclear power reactors. The NRCs regulations limit these renewals to 20-year increments. Approval of a renewed license is based on the outcome of a safety and environmental review. The NRC issued a construction permit for CPS on February 24, 1976, and the NRC issued the operating license on April 17, 1987. The requested renewal would extend the operating license expiration dates for CPS from April 17, 2027, to April 17, 2047.
As part of its review, the NRC has prepared a draft SEIS to its Generic Environmental Impact Statement for License Renewal of Nuclear Plants (LR GEIS), NUREG-1437, Supplement 63.
As stated in our letter dated October 24, 2024 (Package Accession No. ML24285A138), and in accordance with Title 36 of the Code of Federal Regulations (36 CFR) Section 800.8(c), the NRC is complying with Section 106 of the National Historic Preservation Act of 1966, as amended, through the National Environmental Policy Act of 1969, as amended, process.

The NRC has determined that the area of potential effects for this license renewal includes lands within the nuclear power plant site boundary, the transmission lines up to the first substation, and the immediate environs that may be directly or indirectly affected by land disturbing or other operational activities associated with continued plant operations and maintenance and/or refurbishment activities. This determination is made irrespective of land ownership or control.
The draft SEIS includes analyses of relevant environmental issues, including potential impacts to historic, archaeological, and cultural resources from activities associated with license renewal. As discussed in the draft SEIS, the NRC staffs preliminary determination is that license renewal would have no adverse effect to historic properties. Further, the NRCs preliminary recommendation is that the environmental impacts of license renewal are not so great that preserving the option of license renewal for energy-planning decision-makers would be unreasonable. This recommendation is based on: (1) the analysis and findings in the LR GEIS; (2) consultation with Federal, State, Tribal and local agencies; (3) the environmental report submitted by CEG; (4) the NRCs independent environmental review; and (5) consideration of public comments received during the scoping process. After consideration of public comments and comments received from consulting parties, the NRC plans to issue the final SEIS in October 2025.
