By letter dated September 26, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22269A569; non-public), as supplemented by letters dated August 12, 2022 (ML22224A149), November 29, 2022 (ML22333A817), February 8, 2023 (ML23039A141), February 15, 2023 (ML23046A266), March 30, 2023 (ML23089A324), April 5, 2023 (ML23095A223), June 26, 2023 (ML23177A224), July 31, 2023 (ML23212B236),

September 12, 2023 (ML23255A095), October 30, 2023 (ML23303A223), November 21, 2023 (ML23325A206), January 26, 2024 (ML24026A296), February 26, 2024 (ML24057A427),

March 7, 2024 (ML24067A294), and March 18, 2024 (ML24078A275), Constellation Energy Generation, LLC (Constellation; the licensee) submitted license amendment requests to replace the Limerick Generating Station, Units 1 and 2 existing safety-related analog control systems with a single digital control system called plant protection system. The supplement dated September 12, 2023, replaced in its entirety the original license amendment requests dated September 26, 2022. The licensee replaced the original submittal, because it had mistakenly included proprietary information in the non-proprietary parts of the requests. The U.S. Nuclear Regulatory Commission (NRC) staff made all of the original submittal non-public. With the exceptions noted by the licensee in its letter dated September 26, 2023, the content of the replacement and the original are the same.

The purpose of this letter is to inform Constellation that the NRC staff has changed the estimated date to complete the review of the license amendment requests (LARs). The NRC staff has changed the estimate to account for the delays in receiving information that is necessary for the NRC to complete its review. In its letter dated May 23, 2023, Constellation stated that it would provide revisions to system requirement specifications (i.e., SyRS), system design specifications (i.e., SyDS), failure modes and effects analysis (i.e., FMEA), Attachment 1 to the LAR, and license technical report (i.e., LTR) by August 31, 2023, or September 15, 2023.

These documents were submitted to the NRC on January 26, 2024. Separately, in response to a request for additional information concerning component interface module (i.e., CIM),

Constellation provided 17 reports containing new information for review in a letter dated February 26, 2024. Based on the delays in receiving the information identified in Constellations letter dated May 23, 2023, and the substantial amount of new information received on February 26, 2024, the NRC staff has revised the estimate for completing the review from October 31, 2024, to December 9, 2024.

The revised estimate accounts for resulting changes to the scheduled for briefings to the Advisory Committee on Reactors Safeguards on the NRC staff review of the LARs. This estimate is subject to change if there are additional delays in submitting information (e.g., taking longer than 30 days to respond to a request for additional information), significant changes in the proposed digital system described in the application, unanticipated addition to the scope to the review, or a need for second round request for additional information. If there are emergent complexities, emergent challenges, changes to LAR scope, or further delays in providing information, they may impact our estimated completion date, estimated level-of-effort, or both.
