I have reviewed SECY 97-188 rnd considered the additional information provided in
- the General Counsel's memo to Chairman Jackson dated October 6,-_1997 and in the EDO's_ October 3,1997 memo to me. As a result, subject to the following comments, I have no objection to the staff's proposal to reduce expenditures associated with the review of terminated licenses by ending detailed' reviews and inspections of sites under Agreement State jurisdiction, and referring identified cases to the Agreement States for appropriate investigation (Option 3).
Because of a " fairness" issue, toy approval of Option 3 is contingent on the staff being directed to investigate the plausibility of seeking Congressional funding to aid Agreement States in the resolution of contaminated sites whose licenses were terminated by the NRC. Staff should consider how similar funding was made
-available to Agreement States in the Uranium Mill Tailings Radiation Control Act of 1978. The Act specified that an amount of $500,000 be appropriated to the NRC for making grants to Agreeme.at States in need of assistance in implementing the provisions of the Act, e

- While I do not object to staff's proposal to evaluate Agreement State actions to resolve these cases during the IMPEP reviewa,, I do not approve of having State j 7 actions affect findings of adequacy unless there is a clear, significant threat to public l health and safety resulting from the lack of appropriate State action. I also do not
_ approve of burdening the Agreement States with requests to report the resolution of j g each case to NRC in addition to IMPEP reviews. For the purpose of maintaining a '
database on the status of terminated licensee, I believe that staff should'obtain this ,
