Office of Nuclear Reactor Regulation items of Interest Week Ending August 27,1999 fagtina Power & Liaht Comoany (CP&L) Announces Acauisition of Florida Proaress CorDoration On August 23,1999, CP&L and Florida Progress Corporation (FPC) announced that their Boards of Directors had unanim.usly approved a definitive agreement for CP&L to purchase FPC. The new company will be the nation's ninth-largest electric utility based on generating capacity of more than 18,500 megawatts.
Florida Progress Corporation is the corporate parent of Florida Power Corporation which owns ,
j and operates the Crystal River Unit 3 Nuclear Generating Plant. The new company expects savings from the elimination of duplicate corporate and administrative programs and operating l efficiencies including integration of the Crystal River nuclear site with CP&L's three existing j imlear sites (Brunswick, Harris, and Robinson).
The purchase is expected to tde about a year to close, and NRC approval of the license !
transfer aspects of the purchase will be required. l Viroil C. Summer Nuclear Station in a letter dated August 23,1999, South Carolina Electric and Gas Company provided formal notification to the NRC of their intent regarding submittal of an application to renew the Operating License of V. C. Summer Nuclear Station (VCS). The current VCS Operating License will expire August 8,2022. Preparatory work has begun to develop an application for license renewal to be submitted as soon as achievable after August 6,2002, contingent upon final approval of the Board of Directors representing both VCS and South Carolina Public Service Authority.
Cooper Nuclear Station Cooper Nuclear Station's (CNS) Y2K readiness status has been changed from "Y2K ready" as l
reported in their Generic Letter (GL) 98-01 response dated June 28,1999, to "not Y2K ready."
i An incomplete Integrated Contingency Plan, as assessed by the staff, is the reason for the change. An incomplete Integrated Contingency Plan does not change the conclusion regarding completion of licensee remediation activities for safety-related systems and systems that support plant operations and licensee administrative functions. However, the NRC considers that a complete Integrated Contingency Plan is necessary for the licensee to be fully Y2K ready.
CNS management stated that their integrated Contingency Plan will be complete by September 20,1999, which will be confirmed by the staff.
l Another issue potentially affecting CNS's Y2K status is the validity of certain equipment Y2K i compliance evaluations. CNS discovered during an audit of contractor reviews that there were some pieces of equipment that were reported by the contractor to be Y2K compliant that were ENCLOSURE A August 27,1999-4

CNS representatives stated that none of the deficiencies identified to date would change the CNS Y2K readiness status as reported in the GL 98-01 response and no safety-related components are affected. With the goal of determining the scope of the equipment Y2K compliance evaluation issue, CNS representatives stated that they wal perform additional audit samples and develop a plan of action which will be shared with the NRC.
FEMA Meetina with the State of Michigan The Federal Emergency Management Agency (FEMA) met with the State of Michigan in Lansing, MI, on August 18,1999, to discuss the State's attemative approach to dose assessment during emergency situations associated with Michigan's three nuclear power plants (DC Cook, Palisades, and Fermi). Participants in the meeting included representatives from the Michigan Emergency Management Division of the Michigan State Police, the Michigan Department of Environmental Quality, FEMA Headquarters, FEMA Region V, NRC Headquarters (Tom Essig and Falk Kantor, NRR/DIPM/lOLB), NRC Region lli (Roland Lickus, RSLO, and Gary Shear, DRS/PSB), and the three licensees in Michigan. Michigan had revised its emergency plans to delete the capability to do an independent dose assessment based on plant data. The Michigan approach uses a qualitative assessment of the utility's plant data, dose projections, and protective action recommendations in the State Emergency Operations Center by a Technical Support Group which includes a plant liaison person, a State health physics representative, and a health physics liaison person from an unaffected utility. The State also performs dose calculations at its Field Team Center based on actual readings from State radiological field monitoring teams when this information becomes available following a release from the plant. FEMA had reviewed the State plans (first revised in 1997) and evaluated several exercises but did not find the State's altemative approach acceptable.
FEMA's position is that a State should perform independent dose projections based on plant data and that Michigan's approach to do a qualitative review of utility information did not meet
- this standard. At the meeting, the State described its approach to accident assessment in detail. While Michigan has the capability to do quantitative dose assessments based on plant data, the State's position was that the quantitative dose assessment would distract them from doing a more comprehensive assessment of the situation at the plant. An agreement was reached which involves a commitment by the State to utilize its dose assessment capability at the Field Team Center to perform dose projections based on plant data before field measurements are available. FEMA indicated that with this modification, the State approach was acceptable. The NRC concurred in FEMA's assessment. The State is going to revise its emergency plans accordingly. Although the dose assessment capability can be demonstrated during the DC Cook exercise (scheduled for October of this year), the emergency plan change will not have been reviewed and approved by FEMA's Regional Assistance Committee by that time, it is expected that the demonstration of this capability in an approved emergency plan will occur during the Fermi 2 exercise in the Fall of 2000.
Egactor Oversiaht Process improvements The llPB staff sponsored a counterpart meeting with the Regional Directors of the Division of Reactor Projects and Division of Heactor Safety on August 25,1999, to discuss implementation issues with the oversight process pilot program, and 'other policy and program issues.

The next Pilot Program Evaluation Panel (PPEP) meeting is scheduled for November 16-17,
.1999. Feedback from the PPEP meetings to date have been positive. The panel requested presentations on the criteria for measuring the pilot program from NRC, industry, and the public ;
in the next meeting scheduled for November 16-17,1999. The PPEP is chaired by Frank j Gillespie, the Deputy Director of the Division of Inspection Program Management.

Office of Nuclear Material Safety and Safeguards items of interest Week Ending August 27,1999 TranStor Anant Fuel Storaae and Shionino Cask Aoolications The Spent Fuel Project Office notified BNFL Fuel Solutions (BFS) that, due to delays by BFS in responding to staff questions regarding the TranStor Storage and Shipping Cask applications, the staff must modify its review schedule for the applications. BFS is currently determining new dates for submitting all requested information. The staff will revise the review schedule when all of the requested information has been received from BFS.
Wetina with Connecticut Yankee On August 25,1999, staff from the Spent Fuel Project Office met with representatives of NAC intomational, Inc. (NAC) and Connecticut Yankee (CY) regarding CY's plans to pursue dry storage of spent fuel. CY has selected Bechtel as the decommissioning contractor, and has identified the NAC-MPC (storage cask) and the NAC-STC (transport cask) as the dual-purpose cask system to be used. The NAC-STC transport submittal will also address CY's Greater Than Class C waste. The meeting addressed the expected amendment submittals and design changes to the NAC-MPC and the NAC-STC, with submittal expected in January and March 2000, respectively.
DMir, Dir+Mers Wetina on the Revisian of the Fuel Cvele insoection Proaram On August 25,199g, the Director, Division of Fuel Cycle Safety and Safeguards, and the Regional Division Directors, Divisions of Nuclear Materials, met with the Fuel Cycle inspection Program Task Force to discuss the Task Force's draft document on a proposed revision of the fuel cycle facility safety inspection program. This meeting took place at the Nuclear Regulatory Commission Headquarters.. The Division Directors determined that additional effort was required before coordination with stakeholders. A previously planned public meeting with the stakeholders has been postponed and will be rescheduled in the near future.

Office of Nuclear Regulatory Research items of Interest Week Ending August 27,1999 Pubhc Meeting on Debris Transport Test Program On August 18th and 19th, staff from RES and NRR met in Albuquerque, NM, with representatives of Nuclear Energy institute (NEI) and the three pressurized water reactors owners groups (PWROGs) to discuss the NRC-sponsored debris transport test program. The debris transport test program is part of the Generic Safety lasue (GSI) 191 study. The purpose of the GSI-191 study is to determine whether debris accumulation in containment following a postulated loss-of-coolant accident in PWRs will prevent or impede the performance of the emergency core cooling system. The tests will be conducted at the University of New Mexico, and the attendees were given a tour of the test facility.
Los Alamos National Laboratory and the University of New Mexico (NRC's contractors) gave presentations on (1) the purposs of the test program, (2) the design of the test facility, (3) the application of test findings, and (4) the use of plant containment and sump design information provided by PWROGs through NEl. The draft test plan for the NRC-sponsored transport tests is available to stakeholders from the NRC's public document room.
NRC staff and representatives from the PWROGs also discussed the role the PWROGs may play in assessing the significance of debris blockages in PWRs. Currently, the PWROGs, through NEl, are coordinating the collection of containment and sump design information for use in the GSI-191 study. Representatives from various vendors and utilities (domestic and foreign) also attended and participated in this sixth public meeting on the GSl 191 study.
- MOU Sioned Between NRC and DOE on Cooperative Nuclear Safety Research On August 16,1999, Ashok C. Thadani, Director of the Office of Nuclear Regulatory Research, met with William D. Magwood, IV, Director, DOE Office of Nuclear Ene,gy, Science and
' Technology and Madeline A. Feltus, Associate Director, Office of Technology, Office of Nuclear Energy, Science and Technology, to sign a Memorandum of Understanding (MOU) between the NRC and DOE on Cooperative _ Nuclear Safety Research. The NRC and the DOE both conduct research associated with nuclear technology.- Although the goals of the NRC and DOE research programs differ in many respects, the basic data and technical information obtained L through joint research can be useful to each agency in appropriate cases. Accordingly, to conserve resources and to avoid duplication, it is in the best interest of both parties to cooperate and share information and costs related to such research, whenever such cooperation and cost sharing can be done in a mutually beneficial fashion. The MOU, which was signed by Ashok Thadani for the NRC and Madeline Feltus for the DOE, describes the guiding principles under which cooperative research programs between RES and DOE's Office of Nuclear Energy, Science and Technology will be planned and conducted.

Contract Award Contract NRC-33-99-172 was awarded to Qualex Intemational on August 20,1999, for the document duplication services for the NRC's Public Document Room. The total contract value is $1,483,963.00 for a two-year base period and one option year. Initiatives included Use of Oral Presentations.
FaceM Source Selection Test Plan On August 26,1999, DCPM staff met with representatives of the Office of Federal Procurement Policy (OFPP) to discuss the Focused Source Selection test plan. This planned process is the first selected by OFPP to test attemative and innovative procurement procedures authorized by the Federal Acquisition Streamlining Act. Under Focused Source Selection, comments on draft statements of work will be solicited on the Intemet and concurrently, the most promising interested sources will be identified; the three most highly rated sources will develop technical and cost proposals; and negotiations will be held with the top rated proposer. The NRC expects to achieve time savings, cost savings, and increased customer satisfaction on the part of both NRC program offices and private companies doing business with the NRC through the e use of this source selection innovation.

Office of Intemational Programs items of interest Week Ending August 27,1999 Bilateral Aareement Information Exchanae OlP is working with the nuclear regulatory authorities of Brazil, Italy, and South Africa to reach agreement on the renewal texts of our bilateral information exchange and general cooperation arrangements and with the Executive Branch to secure U.S. interagency clearance. The staff hopes to have all details settled in time for Chairman Dieus to sign the renewals for NRC on the margins of the IAEA General Conference in Vienna next month.
Visit of Senior Researcher of the Korean Institute of Nuclear Safety OIP coordinated and participated in the August 24 visit of Mr. Seung-Haeng Lee, Senior Researcher in the Radiation and Waste Safety Evaluation Depanment of the Korean Institute of Nuclear Safety (KINS). ltems of Interest Week Ending August 27,1999 ISFSI Initiation of Saant Fuel Transfer at Susaushanna in September 1999 The Susquehanna nuclear plant, owned by Pennsylvania Power and Light (PP&L) and located on the Susquehanna River near Berwick, PA,is conducting a dry run during August of the process to move spent fuel from the spent fuel pool to a dry fuel storage pad located within the plant boundary. Upon successful demonstration of the equipment, procedures and preparation of the crews involved in the work, the PP&L spent fuel project team plans to initiate the first fuel transfer to the storage location in early September.
Alfonso DeLeo. Jr.
The license issued to Mr. Alfonso DeLeo, Jr. was suspended for non-payment of fees on February 12,1996. Since the licensee failed to dispose of two portable gauges containing licensed material, a civil penalty was proposed on June 2,1999. The licensee was contacted by telephone on August 23,1999, and stated that he is still in possession of and is still in the process of finding a buyer for the two gauges. The licensee was informed that an Order imposing civil penalties for possession of licensed material beyond the 30-day grace period allowed by the NRC's June 2,1999 letter was being issued. The Order was faxed to the licensee and a hard copy was mailed.

Region ll Items of Interest Week Ending August 27,1999 Duke Enerav Corooration - McGuire Emeraency Exercise On August 24,1999, Region 11 participated in an emergency exercise. The Site and Base Teams also participated.
.Ooerational Safeauards Readiness Evaluation (OSRE) St. Lucie On August 23 - 26,1999, Region ll participated in an OSRE at St. Lucie. This was the second of the two OSREs to be conducted in Region 11 under the Reinstated OSRE Program. The Regional Administrator, the Deputy Director, Division of Reactor Safety and the Chief, Operator i Licensing Human Performance and Plant Support Branch, Office of Nuclear Reactor Regulation, also participated in the evaluation.
