APPLICANTS' RESPONSE TO TOWN OF AMESBURY'S RESPONSE AND OBJECTION TO APPLICANTS' MOTION FOR SANCTIONS AND NRC STAFF'S RESPONSE TO APPLICANTS' MOTION FOR SANCTIONS The applicants' reply herein to the Town of Amesbury's Response and Objection to Applicants' Motion for Sanctions and NRC Staff's Response to Applicants' Motion for Sanctions and say that the same should be denied.

The motion for protective order which Amesbury filed was filed only after the motion to compel issued.

therefore out of time under Commission regulations, 10 CFR

One does not file a motion for protective order only after a motion to compel has issued and it was therefore a nullity when filed.

l gi Thus, while applicants acknowledge their inadvertent failure to reference the Town of Amesbury's July 1, 1986 pleading, that pleading constitutes no legal-basis for the present relief sought..Indeed, the. Town of Amesbury did'not even reply to the motion for sanctions when filed.

The Board's order should remain in effect for the Town of Amesbury.
