MINUTES OF THE CRGR MEETING NUMBER 325 The Committee To Review Generic Requirements (CRGR) met on Tuesday, July 21,1998, from 9:00 am to 3:30 pm, to hold the Committee's 325* meeting. Attachment 1 contains a list of attendees.
C. Haughney and R. Parkhill, both of NMSS, briefed the CRGR on a proposed rulemaking related to 10 CFR 71, " Packaging and Transportation of Radioactive Material," and 10 CFR 72,
" Licensing Requirements for the Independent Storage of Spent Nuclear Fuel and High Level Radioactive Waste." Attachment 2 contains the presentation material used by the staff at the meeting. This proposed rulemaking would require implementation of ASME Code requirements for the dual-purpose light-water-reactor spent fuel storage canisters and transportation casks.
The staff's objective in briefing the CRGR was to get the Committee's perspective on this proposal and inform the Committee of the status and schedule of the related activities. The staff also indicated that the associated Standard Review Plan has been issued for public comments.
However, no formal comments were received from a certain industry-supported organization, which was one of the major contributors of adverse comments during the NRC-industry workshop on the subject. The CRGR made various comments and supported the forward-fit approach for the fabricators to address various problems in advance. The Committee also commented that the staff's approach of using the industry consensus standard is consistent with DSI-13, OMB Circular A-119, and Public Law 104-113. Since this was only an information -
briefing, and neither a formal review was requested nor an endorsement was sought, the CRGR did not ask the staff to retum with the modified proposal indicating hcw the Committee's comments and recommendations were addressed.
J. Strosnider, T. Reed and E. Murphy, all of NRR, presented for CRGR reviev' and endorsement the proposed generic letter on steam generator tube integrity. Attachments 3 A through 3-C f
contain the presentation material used by the staff. On June 12,1999, at CRGR Meeting No.
l 322, the staff had briefed the Committee on steam generator tube integrity regulatory

framewo k. At that time, the Committee made extensive comments on the scope and contents of the generic letter. In preparation for CRGR review at the 325* meeting, the staff addressed 2-the Committee's comments provided at the June briefing. At the July meeting, the Committee J
made various comments and recommendations on the scope and approach of the generic letter as well as.on backfit considerations. However, the Committee did not review the draft regulatory guide. Instead, the staff was instructed to make applicable changes to the guide. Specifically, the Committee made the following recommendations:

. The proposed generic letter should not contain explicit references the General Design Criteria (GDC) of Appendix A to 10 CFR 50, specifically, to GDC 31. Consistent with the Commission directive, the CRGR continues to take the position that the GDC can not be generically applied to the pre-1971 licensed plants unless the GDC in question were either imposed by a Commission order or were in the licensing basis of a facility by virtue of the licensee having made written commitments regarding them.

In lieu of voluntary adoption by the licensees of the model technical specifications included in the proposed generic letter, the generic letter should clearly list various programmatic elements, which would have to be satisfied for other attemate licensee-proposed actions.

The licensees should also be afforded the option of taking no further action, provided that they justify in writing to the NRC that their plant-specific program controls and procedures are adequate in ensuring steam generator tube integrity at their respective facilities.

The generic letter should clearly state that operational experience may indicate that there are other elements which, at the licensees' option, may be included in the attemate repair criteria. And, finally, (5)
Given the language included in the as-proposed generic letter, the staff should invoke the compliance exception to the backfit rule.
Subsequently, the staff revised the proposed generic letter to incorporate the Committee's comments and recommendations. The general reference to GDC was eliminated from the text; however, the staff retained references to GDC 14 and GDC 32. The language used in the generic letter was also revised to clearly state that the requested actions were voluntary.
Therefore, the prposed action is no longer a bckfit. The revised proposal was re-submitted to
- the CRGR staff for Committee's abridged, informal review, by seeking the CRGR members' approval by negative consent. The Committee accepted the staffs arguments; however, before formal CRGR endorsement was approved by the CRGR Chairman, the Committee was informed that the NRR management had decided to defer the issuance of the generic letter in light of parallel industry efforts. Nonetheless, the staff was instructed to proceed with the draft regulatory guide. The Committee, at staffs request, deferred CRGR review of the draft guide until after resolution of public comments. This was done with the understanding that based on Committee's review of the proposed generic letter, the staff would make conforming changes to the draft guide before issuing it for comments.

Committee To Review Generic R uir nts
SUBJECT:
MINUTES OF THE CRGR MEETING NUMBER 325 The Committee To Review Generic Requirements (CRGR) met on Tuesday, July 21,1998, from 9:00 am to 3:30 pm, to hold the Committee's 325* meeting. Attachment 1 contains a list of attendees.
C. Haughney and R. Parkhill, both of NMSS, briefed the CRGR on a proposed rulemaking related to 10 CFR 71," Packaging and Transportation of Radioactive Material," and 10 CFR 72,
" Licensing Requirements for the Independent Storage of Spent Nuclear Fuel and High Level Radioactive Waste." Attachment 2 contains the presentation material used by the staff at the meeting. This proposed rulemaking would require implementation of ASME Code requirements for the dual-purpose light-water-reactor spent fuel storage canisters and transportation casks.
The staffs objective in briefing the CRGR was to get the Committee's perspective on this proposal and inform the Committee of the status and schedule of the related activities. The staff also indicated that the associated Standard Review Plan has been issued for public comments.
However, no formal comments were received from a certain industry-supported organization, which was one of the major contributors of adverse comments during the NRC-industry workshop on the subject. The CRGR made various comments and supported the forward-fit approach for the fabricators to address various problems in advance. The Committee also commented that the staffs approach of using the industry consensus standard is consistent with DSI-13, OMB Circu ar A-119, and Public Law 104-113. Since this was only an information 3
briefing, and neither a formal review was requested nor an endorsement was sought, the CRGR did not ask the staff to retum with the modified proposal indicating how the Committee's comments and recommendations were addressed.
J. Strosnider, T. Reed and E. Murphy, all of NRR, presented for CRGR review and endorsement the proposed generic letter on steam generator tube integrity. Attachments 3-A through 3-C contain the presentation material used by the staff. On June 12,1999, at CRGR Meeting No.
322, the staff had briefed the Committee on steam generator tube integrity regulatory j
framework. At that time, the Committee made extensive comments on the scope and contents of the generic letter. In preparation for CRGR review at the 325* meeting, the staff addressed the Committee's comments provided at the June briefing. At the July meeting, the Committee made various comments and recommendations on the scope and approach of the generic letter as well as on backfit considerations. However, the Committee did not review the draft regulatory guide. Instead, the staff was instructed to make applicable changes to the guide. Specifically, the Committee made the following recommendations:

The proposed generic letter should not contain explicit references the General r 3,,,
Criteria (GDC) of Appendix A to 10 CFR 50, specifically, to GDC 31. Consistew v ", the

Commission directive, the CRGR continues to take the position that the GDC can not be generically applied to the pre-19711icensed plants unless the GDC in question were either imposed by a Commission order or were in the licensing basis of a facility by virtue of the licensee having made written commitments regarding them.

In lieu of voluntary adoption by the licensees of the model technical specifications inciuded in the proposed generic letter, the generic letter should clearly list various programmatic elements, which would have to be satisfied for other alternate licensee-proposed actions.
(3)
The licensees should also be afforded the option of taking no further action, provided that they justify in writing to the NRC that their plant-specific program controls and procedures are adequate in ensuring steam generator tube integrity at their respective facilities.
(4)
The generic letter should clearly state that operational experience may indicate that there are other elements which, at the licensees' option, may be included in the alternate repair criteria. And, finally, (5)
Given the language included in the as-proposed generic letter, the staff should invoke the compliance exception to the backfit rule.
Subsequently, the staff revised the proposed generic letter to incorporate the Committee's comments and recommendations. The general reference to GDC was eliminated from the text; however, the staff retained references to GDC 14 and GDC 32. The language used in the generic letter was also revised to clearly state that the requested actions were voluntary.
Therefore, the prposed action is no longer a bckfit. The revised proposal was re-submitted to the CRGR staff for Committee's abridged, informal review, by seeking the CRGR members' approval by negative consent. The Committee accepted the staff's arguments; however, before formal CRGR endorsement was approved by the CRGR Chairman, the Committee was informed that the NRR management had decided to defer the issuance of the generic letter in light of parallel industry efforts. Nonetheless, the staff was instructed to proceed with the draft regulatory guide. The Committee, at staff's request, deferred CRGR review of the draft guide until after resolution of public comments. This was done with the understanding that based on Committee's review of the proposed generic letter, the staff would make conforming changes to the draft gue Sfore issuing it for comments.
In accordance with the JDO's July 18,1983 directive concerning " Feedback and Closure of CRGR Review," a writt, rasponse is required from the cognizant office to report agreement or disagreement with the Ch3 ~
.mendations in these minutes. The response is to be forwarded to the CRGR Chairman and if there is disagreement with the CRGR recommendations, to the EDO for decision making.
